HOUSE BILL NO. 5123

A bill to amend 2006 PA 480, entitled
"Uniform video services local franchise act,"
by amending section 1 (MCL 484.3301).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. (1) This act shall be known and may be cited as the 1
"uniform video services local franchise act". 2
(2) As used in this act: 3
(a) "Cable operator" means that term as defined in 47 USC 4
522(5). 5
(b) "Cable service" means that term as defined in 47 USC 6
October 23, 2025, Introduced by Reps. Harris, Tsernoglou, DeBoyer, Outman, Mentzer, Slagh,
Mueller, Tate, Snyder, Byrnes, Bierlein, BeGole , Bruck, Scott and Liberati and referred to
Committee on Government Operations.

(c) "Cable system" means that term as defined in 47 USC 2
522(7). 3
(d) "Commission" means the Michigan public service commission 4
created in section 1 of 1939 PA 3, MCL 460.1. 5
(e) "Franchising entity" means the local unit of government in 6
which a provider offers video services through a franchise. 7
(f) "Household" means a house, an apartment, a mobile home, or 8
any other structure or part of a structure intended for residential 9
occupancy as separate living quarters. 10
(g) "Incumbent video provider" means a cable operator serving 11
cable subscribers or a telecommunication provider providing video 12
services through the provider's existing telephone exchange 13
boundaries in a particular franchise area within a local unit of 14
government on the effective date of this act.January 1, 2007. 15
(h) "IPTV" means internet protocol television. 16
(i) "Local unit of government" means a city, village, or 17
township. 18
(j) "Low-income household" means a household with an average 19
annual household income of less than $35,000.00 as determined by 20
the most recent decennial census. 21
(k) "Open video system" or "OVS" means that term as defined 22
described in 47 USC 573. 23
(l) "Person" means an individual, corporation, association, 24
partnership, governmental entity, or any other legal entity. 25
(m) "Public rights-of-way" means the area on, below, or above 26
a public roadway, highway, street, public sidewalk, alley, 27
waterway, or utility easements dedicated for compatible uses. 28
(n) "Uniform video service local franchise agreement" or 29

"franchise agreement" means the franchise agreement required under 1
this act to be the operating agreement between each franchising 2
entity and video service provider in this state. 3
(o) "Video programming" means that term as defined in 47 USC 4
522(20). 5
(p) "Video service" means video programming, cable services, 6
IPTV, or OVS provided by a video service provider through 7
facilities located at least in part in the public rights-of-way 8
without regard to delivery technology, including internet protocol 9
technology. This definition Video service does not include any 10
video of the following: 11
(i) Video programming provided by a provider of a commercial 12
mobile service provider as that term is defined in 47 USC 332(d). 13
or provided solely as part of, and via, 14
(ii) Direct-to-home satellite services as that term is defined 15
in 47 USC 303(v). 16
(iii) Video programming accessed via a service that enables 17
users to access content, information, electronic mail, email, or 18
other services offered over the public internet, including 19
streaming content. 20
(q) "Video service provider" or "provider" means a person 21
authorized under this act to provide video service. 22
(r) "Video service provider fee" means the amount paid by a 23
video service provider or incumbent video provider under section 6. 24
(3) The amendatory act that added this subsection does not 25
affect the obligation of a provider that holds a uniform video 26
local franchise agreement on or before the effective date of the 27
amendatory act that added this subsection to provide the 28
compensation required under this act for use of a public right-of-29
