SUBSTITUTE FOR
HOUSE BILL NO. 5338
A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1170c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1170c. (1) By not later than January 1, 2027, the 1
department, in consultation with this state's federally designated 2
organ procurement organization, may develop or adopt, and make 3
available to public schools, a model presentation on organ, eye, 4
and tissue donation and transplantation programs. The model 5
presentation must not exceed 1 class period and must include 6
information about the Michigan organ donor registry. 7
(2) Beginning in the 2027-2028 school year, the board of a 8
school district or intermediate school district or board of 9

directors of a public school academy is encouraged to provide the 1
model presentation described in subsection (1) to students before 2
completion of grade 9. 3
(3) Upon the written request of a student's parent or legal 4
guardian, the student must be excused, without penalty, from 5
attending the model presentation described in subsection (1). 6
