HOUSE BILL NO. 5425

A bill to amend 1994 PA 295, entitled
"Sex offenders registration act,"
(MCL 28.721 to 28.730) by adding section 5d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 5d. (1) An individual required to be registered under 1
this act must not be an employee of a business that primarily 2
provides services to individuals under the age of 18, including, 3
but not limited to, a martial arts studio, dance studio, summer 4
camp, tutoring service, youth sports venue, art and hobby class, 5
December 23, 2025, Introduced by Rep. Bierlein and referred to Committee on Judiciary.

mobile vending business, bowling alley, laser tag center, escape 1
room, or any other business that allows for unsupervised access to 2
individuals less than 18 years of age during activities. 3
(2) Except as otherwise provided in subsection (3), an 4
individual who violates this section is guilty of a misdemeanor 5
punishable by imprisonment for not more than 1 year, a fine of not 6
more than $1,000.00, or both. 7
(3) An individual who commits a second or subsequent violation 8
of this section is guilty of a felony punishable by imprisonment 9
for not more than 4 years, a fine of not more than $2,000.00, or 10
both. 11
(4) At the time of initial registration under this act and at 12
each verification required under this act, the registering 13
authority shall provide each individual required to be registered 14
under this act with written notice of the employment restrictions 15
imposed under this section. The notice must identify the categories 16
of businesses and activities listed in subsection (1) and state 17
that employment in any such business is prohibited. 18
Enacting section 1. This amendatory act takes effect 90 days 19
after the date it is enacted into law. 20
