HOUSE BILL NO. 5511

A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 1a to chapter XI.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
CHAPTER XI 1
Sec. 1a. (1) Except as provided in subsection (2), if the 2
prosecutor of the case agrees after consultation with the victim, a 3
court that is delaying the sentence of a defendant under section 1 4
of this chapter may, at the court's discretion, delay the entry of 5
the judgment of conviction until sentencing is complete, if either 6
February 05, 2026, Introduced by Reps. Edwards, St. Germaine, Mentzer, McFall, Wozniak,
Greene, Rheingans, Xiong, Aragona, Beson, Robinson, Johnsen and Wilson and referred to
Committee on Judiciary.

of the following occurs: 1
(a) The court finds good cause to delay the entry of the 2
judgment of conviction on the record. 3
(b) The defendant is accepted into a specialty court or 4
similar program designed to assist with the rehabilitation of the 5
defendant. 6
(2) A defendant is not eligible for a delayed entry or 7
judgment of conviction under subsection (1) for any of the 8
following convictions: 9
(a) A conviction that is eligible for a delayed sentence under 10
sections 11 to 15 of chapter II, section 4a of chapter IX, or 11
section 7411 of the public health code, 1978 PA 368, MCL 333.7411. 12
(b) A conviction for a traffic offense under the Michigan 13
vehicle code, 1949 PA 300, MCL 257.1 to 257.923, or a violation of 14
a local ordinance substantially corresponding to that act, that 15
involves the operation of a vehicle and at the time of the 16
violation is a felony or a misdemeanor. 17
Enacting section 1. This amendatory act takes effect 90 days 18
after the date it is enacted into law. 19
Enacting section 2. This amendatory act does not take effect 20
unless House Bill No. 5510 (request no. H06068'26) of the 103rd 21
Legislature is enacted into law. 22
