SENATE SUBSTITUTE FOR
HOUSE BILL NO. 5697
A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1531k.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1531k. (1) Beginning with the 2031-2032 school year, the 1
board of a school district or intermediate school district or board 2
of directors of a public school academy shall ensure that the 3
following individuals have successfully completed, as determined by 4
the department, the professional learning described in subsection 5
(2): 6
(a) Except as otherwise provided in this section, certificated 7
individuals who provide, support, or oversee instruction in grades 8
K to 5 that involves reading instruction or language arts, 9

including classroom teachers and teachers with any special 1
education endorsements. This section does not apply to a 2
certificated individual who solely teaches subjects outside of 3
reading instruction or language arts, including, but not limited 4
to, physical education, music, and art. 5
(b) All personnel responsible for the delivery, support, or 6
direct supervision of literacy instruction in grades K to 5, as 7
determined by the department. 8
(2) By not later than 90 days after the effective date of the 9
amendatory act that added this section, the department shall 10
annually approve at least 2 providers to offer the professional 11
learning required under subsection (1). The professional learning 12
described in this subsection must meet at least all of the 13
following requirements: 14
(a) Be offered through a system of training that provides 15
educators with the knowledge base to effectively implement any 16
class-wide, supplemental, or intervention reading approach and to 17
determine why some students struggle with reading, writing, 18
spelling, and language. 19
(b) Provide training activities that direct educators to 20
implement effective reading and spelling instruction supported by 21
scientifically based research and foster a direct explicit 22
instructional sequence that uses techniques to support teachers' 23
independence in using their newly learned skills with students in 24
the classroom. 25
(c) Include integrated components for educators and 26
administrators in grades K to 5 with embedded evaluation or 27
assessment of knowledge. Evaluation or assessment of knowledge 28
under this subdivision must incorporate evaluations of learning 29

throughout each unit and include a summative assessment that must 1
be completed to demonstrate successful course completion. 2
(d) Build teacher content knowledge and pedagogical knowledge 3
of the critical components of literacy, including how the brain 4
learns to read, phonological and phonemic awareness, letter 5
knowledge, phonics, advanced phonics, vocabulary and oral language, 6
fluency, comprehension, spelling and writing, and the organization 7
of language. 8
(e) Support educators in understanding how to effectively use 9
screening, progress monitoring, and diagnostic assessment data to 10
improve literacy outcomes through prevention and intervention for 11
reading difficulties in a multi-tiered system of supports. The 12
multi-tiered system of supports must include at least all of the 13
following essential components: 14
(i) Team-based leadership. 15
(ii) A tiered delivery system. 16
(iii) Selection and implementation of instruction, 17
interventions, and supports. 18
(iv) A comprehensive screening and assessment system. 19
(v) Continuous data-based decision making. 20
(f) Provide that all training, record-keeping systems, and 21
flexible scheduling options are administered by the professional 22
development provider. 23
(g) Include "train the trainer" facilitator professional 24
learning, to be implemented at the discretion of the department. 25
Participants enrolled in facilitator professional learning must 26
have demonstrated successful completion of the required 27
professional learning under subdivisions (a) to (e). 28
(h) Maintain capacity to provide all required training, 29

distribute materials, provide reports to the department, and 1
actively support all participants to mastery completion of 2
coursework. 3
(3) Beginning in the 2026-2027 school year, each school 4
district, intermediate school district, or public school academy 5
shall annually report to the department, in a form and manner 6
prescribed by the department, the number and percentage of 7
individuals described in subsection (1) who have completed the 8
required professional learning under this section, any costs 9
associated with providing the professional learning, and the 10
funding sources used. The department shall compile and publish an 11
annual report summarizing district-level implementation, 12
identifying areas of progress and need, and recommending policy or 13
funding adjustments as necessary to support full compliance by the 14
2031-2032 school year. The department shall submit this report to 15
the governor, state board of education, the house and senate 16
appropriations subcommittees on school aid, and the house and 17
senate education committees, and shall make the report publicly 18
available on the department's website. 19
(4) Beginning in the 2026-2027 school year, the professional 20
learning providers identified in subsection (2) shall annually 21
report all of the following information to the department, in a 22
form and manner prescribed by the department: 23
(a) The total number of individuals described in subsection 24
(1) who have completed the required professional learning, 25
organized by role group. 26
(b) The total number of individuals described in subsection 27
(1) who are enrolled in the required professional development 28
training, organized by role group. 29

(c) The total number of individuals described in subsection 1
(1) who enrolled but withdrew from the required professional 2
development prior to completion, organized by role group. 3
(d) The cost per individual described in subsection (1) to 4
enroll in the required professional learning. 5
(e) The total grant funds expended for all individuals who 6
completed or enrolled in the professional learning during the 7
fiscal year. 8
(f) Total unused grant funds for the fiscal year. 9
(5) The department shall begin a phased implementation of the 10
professional learning required under this section beginning in the 11
2026-2027 school year, and, subject to subsection (6), shall ensure 12
full compliance with this section by not later than the start of 13
the 2031-2032 school year. By not later than 90 days after the 14
effective date of the amendatory act that added this section, the 15
department shall create a statewide implementation plan for the 16
professional learning required under this section in collaboration 17
with statewide associations, literacy experts, and other key 18
partners. The department may issue a good cause extension for 19
compliance with this section to an individual. A good cause 20
extension issued under this subsection must include a deadline, 21
mutually agreed to between the department and the individual, for 22
when the individual must successfully complete the professional 23
learning required under this section. 24
(6) The department may consult with providers approved under 25
subsection (2) and make extensions to the implementation schedule 26
under subsection (5) as the department determines necessary. 27
Extensions made under this subsection may include, but are not 28
limited to, a 1-year extension for full compliance with this 29

(7) The requirements of this section are subject to the 2
appropriation of an amount sufficient to comply with this section. 3
(8) The board of a school district or intermediate school 4
district or board of directors of a public school academy shall 5
ensure that an individual hired during or after the 2031-2032 6
school year into a role described in subsection (1) receives the 7
professional learning required under this section not later than 3 8
years following the start of the individual's employment. 9
(9) If an individual transfers or is moved into a role 10
described in subsection (1), that individual must complete the 11
professional learning required under this section by not later than 12
3 years following the start of the individual's employment in that 13
role. 14
(10) Before implementation of the professional learning 15
required under this section, and subject to subsection (11), a 16
school district, intermediate school district, or public school 17
academy shall create and post on its website a plan that outlines 18
the timeline and manner in which the required professional learning 19
will be completed, including, but not limited to, time expectations 20
beyond contractual work time and how time will be compensated. 21
(11) A school district, intermediate school district, or 22
public school academy shall consult and collaborate with the 23
individuals described in subsection (1) regarding the plan 24
described in subsection (10). 25
(12) The provisions of this section are subject to 1947 PA 26
336, MCL 423.201 to 423.217. 27
(13) This section does not apply to an individual with only an 28
interim teaching certificate under section 1531i. 29

(14) The professional learning required under this section may 1
be provided as part of the professional development provided under 2
section 1527. 3
(15) As used in this section, "multi-tiered system of 4
supports" means a comprehensive framework that includes 3 distinct 5
tiers of instructional support and is composed of a collection of 6
evidence-based strategies designed to meet the individual needs and 7
assets of a whole pupil at all achievement levels. 8
