HOUSE BILL NO. 5719

A bill to amend 1972 PA 203, entitled
"Prosecuting attorneys coordinating office act of 1972,"
by amending sections 2, 3, and 4 (MCL 49.102, 49.103, and 49.104).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 2. As used in this act: 1
(a) "Chief executive officer" means the chief executive 2
officer of the council. 3
(b) (a) "Council" means the prosecuting attorneys coordinating 4
council. 5
(b) "Executive secretary" means the executive secretary of the 6
March 17, 2026, Introduced by Reps. Mueller, Beson and BeGole and referred to Committee on
Judiciary.

(c) "Department" means the department of licensing and 2
regulatory affairs. 3
(d) (c) "Office" means the office of prosecuting attorneys 4
coordination as created in section 3. 5
Sec. 3. (1) The office of prosecuting attorneys coordination 6
is created as an autonomous entity in the department. of attorney 7
general. 8
(2) Except as otherwise provided by law, the office shall 9
exercise its statutory powers, duties, functions, and 10
responsibilities independently of the department. The department 11
shall provide support and coordinated services as requested by the 12
office, including by providing personnel, budgeting, procurement, 13
and other administrative support to the office sufficient to carry 14
out its duties, powers, and responsibilities. 15
(3) (2) The head of the office is the prosecuting attorneys 16
coordinating council. 17
(4) (3) The chief executive officer of the office is the 18
executive secretary who shall must be appointed by the council, and 19
who shall hold office during at the pleasure of the council. He The 20
chief executive officer shall perform the functions and duties as 21
may be assigned to him by the council. The council may employ other 22
persons individuals as it deems necessary to implement the intent 23
and purpose of this act. 24
Sec. 4. (1) The council consists of 5 members selected as 25
follows: 26
(a) The attorney general, or his designated representative. 27
(a) (b) The president of the prosecuting attorneys association 28

(b) (c) One member appointed to the council for a 1-year term, 1
to be elected by the prosecuting attorneys association Prosecuting 2
Attorneys Association of Michigan, who shall must be a prosecuting 3
attorney from a county having a population of over more than 4
400,000 persons.individuals. 5
(c) (d) One member appointed to the council for a 1-year term, 6
to be elected by the prosecuting attorneys association Prosecuting 7
Attorneys Association of Michigan, who shall must be a prosecuting 8
attorney from a county having a population of between 100,000 and 9
400,000 persons.individuals. 10
(d) (e) One member appointed to the council for a 1-year term, 11
to be elected by the prosecuting attorneys association Prosecuting 12
Attorneys Association of Michigan, who shall must be a prosecuting 13
attorney from a county having a population under of less than 14
100,000 persons.individuals. 15
(e) One member appointed to the council for a 1-year term, to 16
be elected by the Prosecuting Attorneys Association of Michigan, 17
who must be a prosecuting attorney from a county having a 18
population of less than 50,000 individuals. 19
(2) A member shall must vacate his the member's appointment 20
upon on termination of his the member's official position as a 21
prosecuting attorney. or attorney general. A vacancy shall must be 22
filled in the same manner as the original appointment. A member 23
appointed to fill a vacancy created other than by expiration of a 24
term shall must be appointed for the unexpired term of the member 25
who he the newly appointed member is to succeed in the same manner 26
as the original appointment. Any member may be reappointed for 27
additional terms. 28
(3) The terms of the members first appointed shall begin on 29
