HOUSE BILL NO. 5924

A bill to regulate the audio of commercial advertisements by
video streaming services; to provide for the powers and duties of
certain state governmental officers; and to prescribe civil
sanctions.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act may be cited as the "commercial advertising 1
loudness mitigation act". 2
Sec. 3. As used in this act: 3
(a) "Commercial advertisement" means material that advertises 4
the commercial availability or quality of property, goods, or 5

services. 1
(b) "Person" means an individual or a partnership, 2
corporation, limited liability company, association, governmental 3
entity, or other legal entity. 4
(c) "Video content" means audiovisual material that is not a 5
commercial advertisement and that a video streaming service makes 6
available for viewing by a consumer. 7
(d) "Video programming" means that term as defined in 47 USC 8
613. 9
(e) "Video streaming service" means, except as otherwise 10
provided in subdivision (f), a person that makes available directly 11
to a consumer in this state, through a distribution method that 12
uses internet protocol, either of the following: 13
(i) Video programming. 14
(ii) Video content. 15
(f) Video streaming service does not include a television 16
broadcast station, cable operator, or other multichannel video 17
programing distributor, or a person that serves video programming 18
or video content without commercial advertisements. 19
Sec. 5. Beginning July 1, 2027, a video streaming service 20
shall not transmit the audio of a commercial advertisement louder 21
than the video programming or video content that the commercial 22
advertisement accompanies. 23
Sec. 7. A video streaming service that violates this act is 24
subject to a civil fine of not more than $10,000.00 for each 25
violation. The attorney general may bring an action to collect the 26
fine. A fine collected must be deposited in the general fund. 27
