SUBSTITUTE FOR
HOUSE BILL NO. 5935
A bill to amend 1972 PA 230, entitled
"Stille-DeRossett-Hale single state construction code act,"
(MCL 125.1501 to 125.1531) by adding section 11b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 11b. (1) Both of the following apply to an application 1
for a building permit or an additional permit that an applicant 2
submits to the department: 3
(a) If the department denies the application for a building 4
permit or an additional permit, the department must notify the 5
applicant of the basis for the denial. The notice must include a 6
citation to the provision of this act, the code, or the 7
requirements of other applicable laws and ordinances on which the 8
denial is based. 9

(b) If the department determines that the application for a 1
building permit or an additional permit is not a complete 2
application, the department must notify the applicant in writing or 3
make the information electronically available to the applicant not 4
later than 7 days after receipt of the application. If the 5
department fails to notify or make the information electronically 6
available to the applicant within the 7-day time period, the 7
application for a building permit or an additional permit is 8
considered to be a complete application. 9
(2) As used in this section, "complete application" means an 10
application complete on its face that is submitted with any 11
applicable permit fees as well as any other information, records, 12
approval, security, or similar item required by law or rule from a 13
local unit of government, federal agency, or private entity but not 14
from another department or agency of this state. 15
Enacting section 1. This amendatory act does not take effect 16
unless all of the following bills of the 103rd Legislature are 17
enacted into law: 18
(a) House Bill No. 5932. 19
(b) House Bill No. 5933. 20
(c) House Bill No. 5934. 21
