HOUSE BILL NO. 6027

A bill to amend 2006 PA 110, entitled
"Michigan zoning enabling act,"
by amending section 207 (MCL 125.3207).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 207. (1) A zoning ordinance or zoning decision shall must 1
not have the effect of totally prohibiting the establishment of a 2
land use within a local unit of government in the presence of a 3
demonstrated need for that land use within either that local unit 4
of government or the surrounding area within the this state, unless 5
a location within the local unit of government does not exist where 6
June 02, 2026, Introduced by Reps. Bierlein, Andrews, Arbit, Price, Steckloff and Snyder and
referred to Committee on Government Operations.

the use may be appropriately located or the use is unlawful. 1
(2) A local unit of government shall not adopt or enforce any 2
ordinance, rule, regulation, or decision, including, but not 3
limited to, a zoning ordinance or decision, that has the effect of 4
totally prohibiting short-term rentals within that local unit of 5
government. 6
(3) As used in this section, "short-term rental" means that 7
term as defined in section 2 of the short-term rental act. 8
Enacting section 1. This amendatory act does not take effect 9
unless Senate Bill No. ____ (request no. S03776'25) or House Bill 10
No. 6026 (request no. H03776'25) of the 103rd Legislature is 11
enacted into law. 12
