HOUSE BILL NO. 6030
A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3406uu.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3406uu. (1) An insurer that delivers, issues for 1
delivery, or renews in this state a group disability insurance 2
policy shall do all of the following: 3
(a) Consider the closure of a health system or the removal of 4
a health system from the insurer's network as a qualifying event 5
for a special enrollment period. 6

(b) Allow an insured to terminate the group disability 1
insurance policy without penalty if a health system in the 2
insurer's network is closed or removed from the insurer's network. 3
(c) Offer a group disability insurance policy to an insured 4
whose group disability policy with another insurer was affected by 5
the closure or removal of a health system in the other insurer's 6
network. 7
(d) If the insurer offers a group disability insurance policy 8
under the circumstances described in subdivision (c), credit the 9
insured any deductibles or out-of-pocket maximum that the insured 10
paid under the other insurer's group disability insurance policy. 11
(2) As used in this section: 12
(a) "Health system" means an entity or affiliated group of 13
entities under common ownership, governance, or control that 14
operates or manages 1 or more hospitals and may also include 15
physician practices, outpatient facilities, long-term care 16
facilities, laboratories, and other health-care-related operations. 17
(b) "Qualifying event" means that term as described in 45 CFR 18
155.420. 19
(c) "Special enrollment period" means that term as described 20
in 45 CFR 155.420. 21
