HOUSE BILL NO. 6039
A bill to amend 1978 PA 16, entitled
"An act to provide reimbursement to counties for expenses relating
to certain felonies, for expenses incurred by implementing special
jurisdictional duties, and for expenses incurred in maintaining
escapees from correctional institutions; and to require reports,"
by amending section 4 (MCL 800.454), as amended by 1987 PA 272.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 4. (1) When If a state committed prisoner who was 1
incarcerated in a state correctional facility has escaped, not 2
returned pursuant to agreement, or violated the terms of his or her 3
the prisoner's parole and has been apprehended pursuant to an order 4
June 03, 2026, Introduced by Rep. Slagh and referred to Committee on Appropriations.

of the department of corrections and is held in a county jail 1
awaiting disposition of his or her the prisoner's case, the 2
department of corrections shall reimburse the county holding the 3
prisoner for the actual and reasonable daily costs , not to exceed 4
$35.00 per day, incurred by the county in holding the prisoner as 5
set by the legislature through the appropriations process. This 6
section shall does not apply to the holding of prisoners awaiting 7
prosecution on new felony charges. 8
(2) Each county shall submit monthly its itemized costs as 9
described in this section to the department of corrections. After 10
determination of reasonableness of the amount to be paid, the 11
department of corrections shall make payment shall be made in 12
accordance with the accounting laws of the this state. The 13
determination of reasonableness by the department of corrections 14
shall be is conclusive. 15
