HOUSE BILL NO. 6058
A bill to amend 1980 PA 299, entitled
"Occupational code,"
(MCL 339.101 to 339.2677) by adding section 216.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 216. (1) Subject to subsection (3), the department shall 1
issue a license or registration for an occupation under this act 2
without examination to an individual if the individual demonstrates 3
to the satisfaction of the department that the individual meets all 4
of the following at the time of application: 5

(a) Holds a valid license or registration in that occupation 1
from an equivalent licensing department, board, or authority, as 2
determined by the department, in at least 1 other state. For each 3
license or registration described in this subdivision that the 4
individual holds, all of the following must be met: 5
(i) The license or registration is in good standing. 6
(ii) The individual has held the license or registration for 7
not less than 1 year. 8
(iii) There were minimum education requirements and, if 9
applicable, work experience and clinical supervision requirements 10
in effect for licensure or registration in the other state, and the 11
other state verifies that the individual met those requirements for 12
licensure or registration in the other state. 13
(iv) If the other state required an examination for licensure 14
or registration, the individual passed the examination. 15
(b) Has not had a license or registration revoked, and has not 16
voluntarily surrendered a license or registration, in any other 17
state or a foreign country while under investigation for 18
unprofessional conduct. 19
(c) Has not had discipline imposed by an equivalent licensing 20
department, board, or authority in another state. If another state 21
has taken disciplinary action against the individual, the 22
department must determine if the cause for the action was corrected 23
and the matter resolved. If the matter has not been resolved by the 24
other state, the department shall suspend the application process 25
and shall not issue or deny a license or registration to the 26
individual until the matter is resolved. 27
(d) Does not have a complaint, allegation, or investigation 28
that relates to unprofessional conduct pending before an equivalent 29

licensing department, board, or authority in another state or a 1
foreign country. If the individual has a complaint, allegation, or 2
investigation pending, the department must suspend the application 3
process and not issue or deny a license or registration to the 4
individual until the complaint, allegation, or investigation is 5
resolved. 6
(e) Pays all applicable fees. 7
(2) This section does not prevent the department from issuing 8
a temporary license or registration under section 213, issuing a 9
courtesy license under section 1806a, or issuing a license or 10
registration under section 217, 726, 1108(2), 1211, 1806(9), 2013, 11
2209, or 2623. 12
(3) If the department administers an examination on the laws 13
specific to this state as a part of the license or registration 14
process for an occupation under this act, the department may 15
require an applicant under this section to take and pass an 16
examination specific to the laws of this state before issuing a 17
license or registration for an occupation under this act. 18
(4) Except as otherwise provided in this section, not later 19
than 90 days after receiving a completed application under this 20
section, the department shall issue or deny the request for a 21
license. 22
(5) This section does not apply to a license issued under an 23
interstate licensing compact applicable to an occupation under this 24
act, does not apply to any licensing criteria established under an 25
interstate licensing compact applicable to an occupation under this 26
act, and does not make an individual who is licensed under this 27
section eligible to be part of an interstate licensing compact 28
applicable to an occupation under this act. 29
