HOUSE BILL NO. 6080
A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1248 (MCL 380.1248), as amended by 2023 PA 116.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1248. (1) This section does not prohibit, impair, or 1
limit the right or duty of a public school employer and a 2
collective bargaining representative to engage in collective 3
bargaining under 1947 PA 336, MCL 423.201 to 423.217. However, a 4
collective bargaining agreement must include, at a minimum, the 5
standards in this section. 6

(2) For teachers, as defined under in section 1249, when 1
filling a vacancy, determining a promotion, placing a teacher in a 2
classroom, or conducting a staffing or program reduction or any 3
other personnel determination resulting in the elimination of a 4
position, the board of a school district or intermediate school 5
district or the board of directors of a public school academy shall 6
not adopt, implement, maintain, or comply with a policy or 7
collective bargaining agreement that provides length of service as 8
the sole factor in personnel decisions. This subsection does not 9
prevent length of service from being considered as a tiebreaker if 10
a personnel decision involves 2 or more employees and all other 11
factors distinguishing those employees from each other are equal. 12
(3) The board of a school district or intermediate school 13
district or board of directors of a public school academy shall 14
adopt, implement, maintain, and comply with clear and transparent 15
procedures for all personnel decisions under this section. 16
Effectiveness as measured under the performance evaluation system 17
in section 1249 or as otherwise collectively bargained must be used 18
as a factor for personnel decisions under this section. Any other 19
relevant factors may be used for personnel decisions under this 20
section, including, but not limited to, the following: 21
(a) The teacher's length of service in a grade level or 22
subject area. 23
(b) The teacher's disciplinary record. 24
(c) Relevant special training. This factor may be based on 25
completion of relevant training other than the professional 26
development or continuing education that is required by the 27
employer or by state law, and integration of that training into 28
instruction in a meaningful way. Any graduate-level coursework 29

considered under this subdivision must meet at least both of the 1
following: 2
(i) Be graduate-level degree-eligible credit offered by an 3
institutionally accredited higher education institution and 4
documented on an official academic transcript. 5
(ii) Result in a letter grade. Graduate-level coursework graded 6
solely on a pass/fail, satisfactory/unsatisfactory, or completion 7
basis is not eligible for consideration under this subdivision 8
unless converted to a letter grade consistent with institutional 9
grading standards. 10
(4) As used in this section: 11
(a) "Graduate-level coursework" means any graduate-level 12
course completed by a certificated teacher for the purpose of 13
salary advancement, salary lane change, or other compensation-14
related advancement under a collective bargaining agreement, school 15
district policy, or salary schedule. 16
(b) "Graduate-level degree-eligible credit" means academic 17
credit provided by an institutionally accredited higher education 18
institution that may be applied toward a master's degree, education 19
specialist degree, or doctoral degree. 20
