HOUSE BILL NO. 6082

A bill to amend 1972 PA 230, entitled
"Stille-DeRossett-Hale single state construction code act,"
(MCL 125.1501 to 125.1531) by adding section 13h.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 13h. (1) Except as otherwise provided in subsection (2), 1
if an owner of an existing building or structure seeks to convert 2
the building or structure into an accessory dwelling unit, the 3
building or structure must have a foundation that complies with the 4
frost protection requirements in the code. 5
(2) Subsection (1) does not apply to a building or structure 6

if the owner of the building or structure includes both of the 1
following with the owner's application for a building permit: 2
(a) An attestation that the building or structure was 3
constructed not less than 10 years before the date the owner 4
submits the application. 5
(b) A statement from a structural engineer that indicates the 6
building or structure does not have any evidence of significant 7
frost heaving that would cause concern for the structural integrity 8
of the building or structure. 9
