HOUSE BILL NO. 6101

A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3406qq.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3406qq. (1) An insurer that delivers, issues for 1
delivery, or renews in this state a health insurance policy shall 2
cap any co-pay or coinsurance, as applicable, for insulin products 3
selected by the insurer at an amount not to exceed $35.00 for each 4
30-day supply of selected insulin products. The co-pay or 5

coinsurance cap must be applied to at least 1 insulin product, as 1
selected by the insurer, within each of the following categories: 2
(a) Rapid-acting. 3
(b) Short-acting. 4
(c) Intermediate-acting. 5
(d) Long-acting. 6
(e) Ultra-long-acting. 7
(f) Premixed. 8
(2) An insurer cannot achieve compliance with this section by 9
increasing cost-sharing requirements, reclassifying benefits with 10
respect to selected insulin products by the insurer, or imposing 11
more restrictive treatment limitations on selected insulin 12
products. 13
(3) This section does not prevent an insurer described in 14
subsection (1) from doing either of the following: 15
(a) Reducing a co-pay or coinsurance, as applicable, for a 16
covered selected insulin product to an amount less than $35.00 for 17
each 30-day supply of the selected insulin product. 18
(b) Imposing a co-pay or coinsurance for a covered benefit 19
that is not a selected insulin product at an amount that exceeds 20
$35.00. 21
(4) Beginning July 1, 2027 and each July 1 after that date, 22
the director shall adjust the dollar amount under subsections (1) 23
and (3) in accordance with the Consumer Price Index. 24
(5) As used in this section: 25
(a) "Consumer Price Index" means the most comprehensive index 26
of consumer prices available for the Detroit-Warren-Dearborn area 27
from the United States Department of Labor, Bureau of Labor 28
Statistics. 29

(b) "Cost-sharing requirement" means deductibles, copayments, 1
coinsurance, out-of-pocket expenses, aggregate lifetime limits, and 2
annual limits. 3
(c) "Selected insulin product" means an insulin product 4
selected by the insurer in accordance with subsection (1). 5
Enacting section 1. This amendatory act applies to health 6
insurance policies delivered, executed, issued, amended, adjusted, 7
or renewed in this state, or outside of this state if covering 8
residents of this state, after June 30, 2026. 9
