HOUSE BILL NO. 6106
A bill to amend 2022 PA 180, entitled
"An act to establish a student mental health apprenticeship
retention and training (SMART) internship grant program; to
prescribe conditions for the administration of the student mental
health apprenticeship retention and training (SMART) internship
grant program; to prescribe certain powers and duties of certain
state officers, agencies, and departments; and to require the
promulgation of rules,"
by amending section 3 (MCL 388.1953).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3. (1) The department shall create and administer a 1

Workforce.

student mental health apprenticeship retention and training (SMART) 1
internship grant program to provide grants to designated recipients 2
and to provide grants to field supervisors, field instructors, and 3
supervisors as described in this act. It is the intent of the 4
legislature that the grant program lead to , at a minimum, both of 5
the following: 6
(a) The the provision of paid and educationally meaningful 7
internship practicum in school settings for designated recipients. 8
(b) The utilization of funding obtained by a public school 9
under section 31o of the state school aid act of 1979, 1979 PA 94, 10
MCL 388.1631o, as permitted under that section, to hire designated 11
recipients who obtained a grant under this act. 12
(2) The department shall administer grant funding through the 13
grant program to designated recipients through agreements. The 14
agreements described in this subsection must meet the following 15
criteria: 16
(a) Subject to subsection (4), the department shall administer 17
grant funding as described in this subsection in an amount per 18
eligible designated recipient that is equal to $25.00 per hour for 19
each hour spent in an intern capacity for up to 20 hours per week 20
of an internship in a public school that occurs over a 30-week 21
period in a school year or a lump sum amount equal to $15,000.00 22
for up to 20 hours per week of an internship in a public school 23
that occurs over a 30-week period in a school year. The lump sum 24
amount described in this subdivision must be paid at the end of the 25
30-week period described in this subdivision. As used in this 26
subdivision, "eligible designated recipient" means a designated 27
recipient to whom both of the following apply: 28
(i) Either Any of the following: 29

(A) The individual is enrolled in a graduate-level mental 1
health professional program described in section 1(c), who is in 2
the first year of an internship period required by the program, and 3
who is serving as a substitute teacher or in a paraprofessional 4
role in a public school as described in this subdivision or who is 5
in a supervised role in a public school as described in this 6
subdivision and following best-practice training and supervision 7
requirements as indicated by national standards set forth by the 8
appropriate national professional organizations. As used in this 9
sub-subparagraph, "supervised role" means a role in which the 10
individual is supervised by a field supervisor, field instructor, 11
or supervisor while he or she the individual is serving in the 12
role. 13
(B) The individual is enrolled in a graduate-level mental 14
health professional program described in section 1(c), who is in 15
the second year of an internship period required by the program, 16
and who is in a supervised role in a public school as described in 17
this subdivision and following best-practice training and 18
supervision requirements as indicated by national standards set 19
forth by the appropriate national professional organizations. As 20
used in this sub-subparagraph, "supervised role" means a role in 21
which the individual is supervised by a field supervisor, field 22
instructor, or supervisor while he or she the individual is serving 23
in the role. 24
(C) The individual is enrolled in a graduate-level mental 25
health professional program described in section 1(c), is in the 26
third year of an internship period required by the program, and is 27
in a supervised role in a public school as described in this 28
subdivision and following best-practice training and supervision 29

requirements as indicated by national standards set forth by the 1
appropriate national professional organizations. As used in this 2
sub-subparagraph, "supervised role" means a role in which the 3
individual is supervised by a field supervisor, field instructor, 4
or supervisor while the individual is serving in the role. 5
(ii) At least 1 of the following applies to the individual's 6
work as described under in this subdivision: 7
(A) The individual is interning in a discipline that has been 8
designated as critical shortage by the superintendent of public 9
instruction for the immediately preceding school fiscal year under 10
section 38 of the public school employees retirement act of 1979, 11
1980 PA 300, MCL 38.1361. 12
(A) (B) The individual is interning in a public school in 13
which not less than 50% of pupils enrolled are eligible for free or 14
reduced-price meals under the Richard B. Russell national school 15
lunch act, 42 USC 1751 to 1769j.were identified as economically 16
disadvantaged during the immediately preceding school year. 17
(B) (C) The individual is interning in a public school that 18
received funding under section 22d of the state school aid act of 19
1979, 1979 PA 94, MCL 388.1622d, in the immediately preceding 20
school fiscal year. 21
(b) Include a requirement that Encourage the designated 22
recipient who receives funding through the grant program shall to 23
work at a public school for not less than 3 school years as of the 24
date of the agreement. 25
(3) A payment or payments of funding through the grant program 26
must be made as follows to designated recipients, pursuant to an 27
agreement between the designated recipient, the public school in 28
which he or she the designated recipient is interning as described 29

in subsection (2), and the graduate-level mental health 1
professional program described in section 1(c) that he or she in 2
which the designated recipient is enrolled: 3
(a) On the same pay period or schedule offered to other 4
educational professionals at the public school in which the 5
designated recipient is serving for purposes of qualifying for 6
funding under this act. 7
(b) Through 1 lump-sum payment on the date on which the 8
designated recipient's service for purposes of qualifying for 9
funding under this act ends. 10
(4) Both of the following apply to funding distributions as 11
described in subsection (2), as applicable: 12
(a) For recipients of the funding who receive $25.00 per hour 13
as described in subsection (2), both of the following: 14
(i) If the recipient permanently ceases to satisfy the 15
qualification requirements that initially made the recipient 16
eligible for funding under this act either by his or her the 17
recipient's own initiative, by initiative of the public school in 18
which he or she the recipient was interning, or by initiative of 19
the graduate-level mental health professional program described in 20
section 1(c), payments must stop as of the date on which this 21
occurs. 22
(ii) If the recipient temporarily ceases to satisfy the 23
qualification requirements that initially made the recipient 24
eligible for funding under this act because he or she the recipient 25
is relocating to intern in another public school or due to a leave 26
of absence, payments must stop during the period which the 27
individual recipient does not meet the requirements, but may be 28
continued when the individual recipient again meets the 29

qualification requirements, but must not be continued beyond 30 1
weeks from the date the individual recipient initially started his 2
or her the recipient's internship at the public school under 3
subsection (2). 4
(b) For recipients of the funding who receive the lump sum of 5
$15,000.00 as described in subsection (2): 6
(i) If the recipient permanently ceases to satisfy the 7
qualification requirements that initially made the recipient 8
eligible for funding under this act either by his or her the 9
recipient's own initiative, by initiative of the public school in 10
which he or she the recipient was interning, or by initiative of 11
the graduate-level mental health professional program described in 12
section 1(c), the recipient may receive a pro rata amount of the 13
lump sum that reflects the number of hours the individual recipient 14
interned at the public school while meeting the qualification 15
requirements for funding under this act. 16
(ii) If the recipient temporarily ceases to satisfy the 17
qualification requirements that initially made the recipient 18
eligible for funding under this act because he or she the recipient 19
is relocating to intern in another public school or due to a leave 20
of absence, the individual recipient is still eligible to receive 21
the full amount of the lump sum if he or she the recipient 22
completes all of the qualification requirements for funding under 23
this act. 24
(5) The department may, for extenuating circumstances, make a 25
debt or expense repayment to a designated recipient before or 26
during each year of service that the designated recipient will 27
complete or is completing for purposes of qualifying for funding 28
under this act. 29

(6) Each state university that designated recipients are 1
enrolled in for the graduate-level mental health professional 2
program described in section 1(c) may continue implementing any 3
existing evaluation processes required as part of any 4
certification, licensing, or approval requirements associated with 5
serving as a school mental health professional. For purposes of 6
this act, the results from an evaluation described in this 7
subsection may be used as a reason for the individual's 8
disqualification for grant funding under this act. 9
(7) A designated recipient that receives a grant under this 10
act shall submit any evaluations he or she the designated recipient 11
receives as described in subsection (6) and any evaluations 12
received from the public school in which he or she the designated 13
recipient is interning as described in subsection (2) to the 14
department. Upon receiving an evaluation as described in this 15
subsection, the department shall determine whether the designated 16
recipient is still eligible to receive grant funding under this 17
section or whether the designated recipient is subject to 18
subsection (4) and shall notify the designated recipient of its the 19
department's determination. 20
(8) The department shall administer grant funding through the 21
grant program to field supervisors, field instructors, or 22
supervisors. A grant to a field supervisor, field instructor, or 23
supervisor under this subsection must not exceed $250.00 for each 24
designated recipient that he or she the field supervisor, field 25
instructor, or supervisor supervises. 26
(9) A designated recipient who receives a grant under this act 27
is not prohibited from applying for another grant under this act if 28
he or she the designated recipient meets the qualifications for 29

grant funding under this act. 1
(10) Payments made under this act must not be counted toward 2
student financial aid packages or other indirect costs, unless the 3
designated recipient designates that is how they wish the funds to 4
be used. 5
