HOUSE BILL NO. 6107

A bill to amend 1977 PA 72, entitled
"The medicaid false claim act,"
by amending section 4 (MCL 400.604).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 4. A person who that solicits, offers, or receives a 1
kickback or bribe in connection with the furnishing of goods or 2
services for which payment is or may be made in whole or in part 3
pursuant to under a program established under Act No. 280 of the 4
Public Acts of 1939, as amended, who the social welfare act, 280 PA 5
1939, MCL 400.1 to 400.119b, makes or receives the payment, or who 6
June 18, 2026, Introduced by Reps. Steckloff, Morgan, Conlin, Roth, McFall, Rogers, Pohutsky,
Weiss, Dievendorf, Wegela, Scott and Snyder and referred to Committee on Health Policy.

receives a rebate of a fee or charge for referring an individual to 1
another person for the furnishing of the goods and services is 2
guilty of a felony, punishable by imprisonment for not more than 4 3
years, or by a fine of not more than $30,000.00, or both. Model 4
arrangements and model patient incentives, as authorized and 5
sponsored by the Centers for Medicare and Medicaid Services, do not 6
constitute a kickback or bribe under this section. 7
