HOUSE BILL NO. 6128

An act to prescribe the powers and duties of certain state and
local officials and officers.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act: 1
(a) "Law enforcement officer" means that term as defined in 2
section 2 of the Michigan commission on law enforcement standards 3
act, 1965 PA 203, MCL 28.602. 4
(b) "Open fields doctrine" means the exception to the Fourth 5
Amendment to the United States Constitution established by the 6
United States Supreme Court in Hester v United States, 265 US 57 7
June 24, 2026, Introduced by Reps. Martin, Prestin, Markkanen, Kunse, Jenkins-Arno, Alexander,
Cavitt, Maddock, Greene, Wozniak, Beson, Schmaltz, Frisbie, BeGole, Borton, Mueller, Kelly,
Johnsen, Rigas, Fox, Outman, Neyer, Bruck, St. Germaine, Fairbairn, B ohnak, Bierlein and
VanderWall and referred to Committee on Judiciary.
