HOUSE BILL NO. 6135
A bill to amend 1939 PA 3, entitled
"An act to provide for the regulation and control of public and
certain private utilities and other services affected with a public
interest within this state; to provide for alternative energy
suppliers and certain providers of electric vehicle charging
services; to provide for licensing; to include municipally owned
utilities and other providers of energy under certain provisions of
this act; to create a public service commission and to prescribe
and define its powers and duties; to abolish the Michigan public
utilities commission and to confer the powers and duties vested by
law on the public service commission; to provide for the powers and
duties of certain state governmental officers and entities; to
provide for the continuance, transfer, and completion of certain
matters and proceedings; to abolish automatic adjustment clauses;
to prohibit certain rate increases without notice and hearing; to

qualify residential energy conservation programs permitted under
state law for certain federal exemption; to create a fund; to
encourage the utilization of resource recovery facilities; to
prohibit certain acts and practices of providers of energy; to
allow for the securitization of stranded costs; to reduce rates; to
provide for appeals; to provide appropriations; to declare the
effect and purpose of this act; to prescribe remedies and
penalties; and to repeal acts and parts of acts,"
(MCL 460.1 to 460.11) by adding section 10ii.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10ii. (1) By 180 days after the effective date of the 1
amendatory act that added this section, the commission shall 2
establish large-load commercial rates for data centers. The rates 3
must do all of the following: 4
(a) Require that a data center enter into a contract with the 5
utility for at least 15 years. 6
(b) Require a minimum monthly billing charge for a data center 7
that is based on not less than 60% of the data center's contracted 8
demand and applies regardless of actual electricity consumption. 9
(c) If the data center terminates service with the utility, 10
require a fee to be charged to the data center equal to the monthly 11
billing charge under subdivision (b) times the remaining months of 12
the contract. 13
(d) Require collateral equal to at least 24 months of the 14
maximum monthly nonfuel billing charge. 15
(e) Ensure that all generation, transmission, or distribution 16
costs caused by the data center are paid by the data center and not 17
existing electric utility customers. 18
(2) As used in this section, "data center" means a facility in 19
this state that is composed of 1 or more buildings and that is 20
designed and intended for housing, and does house, data center 21

equipment to centralize the storage and processing of data. 1
Enacting section 1. This amendatory act does not take effect 2
unless all of the following bills of the 103rd Legislature are 3
enacted into law: 4
