HOUSE BILL NO. 6139

A bill to amend 1972 PA 230, entitled
"Stille-DeRossett-Hale single state construction code act,"
(MCL 125.1501 to 125.1531) by adding section 10a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10a. (1) In addition to the requirements under section 1
10, an application for a building permit that is for a data center 2
must include an acoustic engineering report conducted by an 3
acoustic engineer. The acoustic engineering report must include all 4
of the following information: 5
(a) Before construction of the data center begins, a baseline 6
June 25, 2026, Introduced by Reps. Scott, Andrews, Grant, Tsernoglou, Breen, Steckloff, O'Neal,
Wooden, Arbit, Foreman, Hoskins, Snyder, Liberati, Rogers, McFall, Morgan, Martus,
Rheingans, Skaggs, Witwer, MacDonell, McKinney, Wegela, Wilson, Conlin, Brixi e,
Herzberg and Fitzgerald and referred to Committee on Government Operations.

for the ambient noise levels along the property boundaries where 1
the data center will be located and the surrounding residential 2
structures. 3
(b) A model of the operational noise that the data center is 4
projected to produce. The model must be completed in accordance 5
with standards published by the International Organization for 6
Standardization in ISO 9613-2. 7
(c) A model of the noise that the construction of the data 8
center is projected to produce. 9
(d) The differences in the data center's projected ambient 10
noise levels during the hours of 7:00 a.m. to 5:00 p.m. and its 11
projected ambient noise levels during the hours of 6:00 p.m. to 12
6:00 a.m. 13
(e) A comparison of the data center's operational noise levels 14
determined under subdivision (b) and any noise ordinance of the 15
local unit of government where the data center will be located. If 16
the local unit of government does not have a noise ordinance, the 17
comparison must be made to a nationally recognized standard, as 18
determined by the department. 19
(2) An enforcing agency that receives an acoustic engineering 20
report under this section shall provide that report to the Michigan 21
public service commission and the local unit of government where 22
the data center will be located. The enforcing agency must comply 23
with the requirements of this subsection before it issues a 24
building permit. 25
(3) As used in this section: 26
(a) "Acoustic engineer" means an acoustic engineer who is 27
licensed as a professional engineer under article 20 of the 28
occupational code, 1980 PA 299, MCL 339.2001 to 339.2014. 29

(b) "Data center" means a facility that is composed of 1 or 1
more buildings and that is designed and intended to house, and does 2
house, data center equipment to centralize the storage and 3
processing of data. 4
Enacting section 1. This amendatory act takes effect 180 days 5
after the date it is enacted into law. 6
Enacting section 2. This amendatory act does not take effect 7
unless all of the following bills of the 103rd Legislature are 8
enacted into law: 9
(a) Senate Bill No. ____ (request no. S06933'26) or House Bill 10

(b) Senate Bill No. ____ (request no. S06939'26) or House Bill 12
No. 6137 (request no. H06939'26). 13
