HOUSE BILL NO. 6145

A bill to amend 1984 PA 431, entitled
"The management and budget act,"
by amending section 242 (MCL 18.1242), as amended by 2012 PA 430.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 242. (1) State agencies, community colleges, school 1
districts, intermediate school districts, and universities shall 2
develop 5-year capital outlay plans, which shall must identify 3
capital outlay needs, including new construction, or the addition, 4
renovation, adaptive reuse, and improvement of existing facilities. 5
For state agencies, community colleges, school districts, 6

Longjohn, Breen, Rheingans, Byrnes, Foreman, Steckloff, Miller, MacDonell, Conlin,
Tsernoglou, Dievendorf and Fitzgerald and referred to Committee on Appropriations.

intermediate school districts, and universities, the 5-year capital 1
outlay plans shall must also include the need for special 2
maintenance. These plans shall must be submitted in electronic 3
format to the department, to members of the JCOS, and to the fiscal 4
agencies not later than November 1 of each year. 5
(2) The department and the JCOS shall review state agency, 6
community college, school district, intermediate school district, 7
and university capital outlay plans. The department and the JCOS 8
shall prioritize requests. The department shall include the 9
department-recommended requests in the executive budget 10
recommendation. If a state agency, community college, school 11
district, intermediate school district, or university subsequently 12
modifies a request, the revision shall must be submitted to the 13
department, members of the JCOS, and the fiscal agencies. 14
(3) The department and the chairperson and vice-chairperson of 15
the JCOS shall review and evaluate by March 1 of each year capital 16
outlay project requests received from community colleges, 17
universities, school districts, intermediate school districts, and 18
state agencies. All of the following shall must be considered when 19
reviewing and evaluating project requests: 20
(a) Investment in existing facilities and infrastructure. 21
(b) Life and safety deficiencies. 22
(c) Occupancy and utilization of existing facilities. 23
(d) Integration of sustainable design to enhance the 24
efficiency and operations of the facility. 25
(e) Estimated cost. 26
(f) Institutional support. 27
(g) Estimated operating costs. 28
(h) Impact on tuition, if any. 29

(i) Impact on job creation in this state. 1
(j) History of prior appropriations received by the 2
institution through the capital outlay process. 3
(4) The request for program development and schematic planning 4
must be approved by the JCOS and the legislature through the 5
appropriation process. 6
(5) Program statements and schematic planning documents shall 7
must be reviewed by the department and, when the review is 8
completed, shall must be submitted to the JCOS as either approved 9
or not approved. 10
(6) Upon review and approval by the JCOS, the JCOS and the 11
legislature may authorize the project for final design and 12
construction with a line-item appropriation in an appropriation 13
bill. The appropriations appropriation bill shall must include 14
appropriations for projected state building authority rental 15
payments associated with the projects that are authorized for 16
construction. The authorization shall must include the legislative 17
lease approval required for state building authority financing. 18
(7) Preliminary plans shall must be submitted to the 19
department for review and approval. The department shall review and 20
approve final plans to be prepared for bidding. A summary of bid 21
results shall must be submitted to the JCOS. 22
(8) The department shall provide for review and oversight of 23
capital outlay projects financed either in total or in part by the 24
state building authority pursuant to the provisions of in 25
accordance with sections 237 and 237a. 26
(9) Appropriations made for studies and initial plans shall 27
are not be considered a commitment on the part of the legislature 28
to appropriate funds for the completion of plans or construction of 29

any project based on the studies or planning documents. 1
(10) This section applies to a school district or intermediate 2
school district that elects to comply with this section. The 3
department shall create a process for a school district or 4
intermediate school district to elect to comply with this section. 5
(11) As used in this section: 6
(a) "Intermediate school district" means that term as defined 7
in section 4 of the revised school code, 1976 PA 451, MCL 380.4. 8
(b) "School district" means that term as defined in section 6 9
of the revised school code, 1976 PA 451, MCL 380.6. 10
