HOUSE BILL NO. 6149

A bill to amend 1986 PA 268, entitled
"Legislative council act,"
(MCL 4.1101 to 4.1901) by adding section 751.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 751. (1) Before February 1 of each year, the majority 1
party in the house of representatives, the majority party in the 2
senate, the minority party in the house of representatives, and the 3
minority party in the senate shall each appoint 1 individual to 4
serve as a department head salary panelist for the immediately 5
June 30, 2026, Introduced by Reps. Carra, Borton, Schriver, Kelly, Greene, St. Germaine and
DeSana and referred to Committee on Government Operations.

following fiscal year. An individual is ineligible to serve as a 1
panelist if the individual, at any time after the individual's 2
appointment and before the end of the fiscal year for which the 3
individual serves, holds an elective office in this state or is a 4
candidate for an elective office in this state. The majority and 5
minority parties shall fill a vacancy in the same manner as the 6
original appointment, and a panelist appointed to fill a vacancy 7
shall serve for the remainder of the original appointment. A 8
panelist shall serve without compensation. However, a panelist may 9
be reimbursed for actual and necessary expenses incurred in the 10
performance of the panelist's official duties as a panelist. 11
(2) A panelist shall do all of the following: 12
(a) Rate the head of each of the principal departments in the 13
executive branch in accordance with subsection (3). However, a 14
panelist shall not rate a head of a principal department whose 15
salary is determined under section 12 of article IV of the state 16
constitution of 1963. 17
(b) Prepare a report that explains the panelist's ratings 18
under subdivision (a). 19
(c) Before December 31 of the year in which the panelist is 20
appointed, transmit the report prepared under subdivision (b) to 21
the house fiscal agency. 22
(3) A panelist shall rate the head of each of the principal 23
departments in the executive branch on both of the following using 24
a scale of 1 to 100, with 1 being the lowest possible rating, 100 25
being the highest possible rating, and a rating of 50 being 26
equivalent to an average performance: 27
(a) Quality of work of the department. 28
(b) Cost effectiveness of the department. 29

(4) The house fiscal agency shall do both of the following: 1
(a) Calculate a recommended salary for the head of each of the 2
principal departments using the following formula: 3
(i) Add the ratings of all the panelists under subsection 4
(3)(a). 5
(ii) To the sum calculated under subparagraph (i), add the 6
ratings of all the panelists under subsection (3)(b). 7
(iii) Divide the sum calculated under subparagraph (ii) by 100. 8
(iv) Multiply the quotient calculated under subparagraph (iii) by 9
0.2. 10
(v) Multiply the product calculated under subparagraph (iv) by 11
75% of the governor's salary then in effect. 12
(vi) To the product calculated under subparagraph (v), add 25% 13
of the governor's salary then in effect. 14
(b) Transmit the salaries calculated under subdivision (a) to 15
all of the following individuals: 16
(i) The speaker of the house. 17
(ii) The senate majority leader. 18
(iii) The governor. 19
(iv) The chair of the house of representatives standing 20
committee on appropriations. 21
(v) The chair of the senate standing committee on 22
appropriations. 23
