HOUSE BILL NO. 6158

A bill to prohibit governmental entities from allowing access
to certain nonpublic areas under certain circumstances; and to
provide for the powers and duties of certain state and local
governmental officers and entities.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act may be cited as the "safe access to 1
facilities act". 2
Sec. 2. As used in this act: 3
(a) "Federal immigration authority" means a federal 4
immigration officer. 5

(b) "Governmental entity" means a state department or agency 1
or a local unit of government. 2
(c) "Judicial warrant" means a warrant issued by a court that 3
is based on probable cause. 4
(d) "Nonpublic area" means an area not open to the public. 5
Sec. 3. A governmental entity shall not knowingly grant a 6
federal immigration authority access to a nonpublic area without a 7
judicial warrant. 8
Sec. 4. (1) This act does not do any of the following: 9
(a) Restrict a criminal investigation. 10
(b) Interfere with the execution of a judicial warrant. 11
(c) Limit cooperation in a criminal matter. 12
(d) Restrict actions necessary to address an immediate threat 13
to public safety. 14
(e) Delay, restrict, or interfere with access necessary to 15
provide emergency medical care or to protect the immediate health 16
and safety of an individual. 17
(f) Prohibit or restrict lawful federal enforcement actions. 18
(2) This act governs only the conduct of state and local 19
governmental entities and employees. 20
