HOUSE BILL NO. 6174
A bill to amend 1969 PA 224, entitled
"An act to license and regulate dealers that deliver, transport,
board, buy, or sell dogs or cats for laboratory research purposes;
to regulate research facilities that use dogs or cats for
laboratory research; to require research facilities to offer
laboratory animals no longer needed for laboratory research to
certain animal protection shelters for adoption before euthanizing;
to require research facilities to submit annual reports; to provide
immunity from civil liability under certain conditions; to create
certain funds; and to repeal acts and parts of acts,"
by amending section 1 (MCL 287.381), as amended by 2023 PA 315.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act: 1

(a) "Animal protection shelter" means a facility that is 1
registered licensed with the department under section 6 4 of 1969 2
PA 287, MCL 287.336, 287.334, and is operated by any of the 3
following: 4
(i) A person. 5
(ii) A humane society. 6
(iii) A society for the prevention of cruelty to animals. 7
(iv) Any other nonprofit organization for the care of homeless 8
animals. 9
(b) "Cat" means a domestic cat of any age of the species Felis 10
catus. 11
(c) "Dealer" means a person that for compensation or profit 12
delivers for transportation, transports, boards, buys, or sells 13
dogs or cats for research purposes. Dealer does not include a 14
person that breeds or raises dogs or cats for sale to a research 15
facility. 16
(d) "Department" means the department of agriculture and rural 17
development. 18
(e) "Director" means the director of the department. 19
(f) "Dog" means a domestic dog of any age of the species Canis 20
lupus familiaris. 21
(g) "Laboratory animal" means a dog or cat that is used or 22
intended to be used for laboratory research at a research facility. 23
(h) "Laboratory research" means research, tests, or 24
experiments conducted for education, scientific, medical, or 25
experimental purposes. 26
(i) "Municipality" means a county, city, village, or township. 27
(j) "Person" means an individual, estate, business or 28
nonprofit entity, public corporation, government or governmental 29

subdivision, agency, or instrumentality, or other legal entity. 1
(k) "Research facility" means a school, hospital, laboratory, 2
institution, organization, or person that is licensed or otherwise 3
registered with the United States Department of Agriculture, that 4
uses or intends to use a laboratory animal in laboratory research, 5
and that does 1 or both of the following: 6
(i) Purchases or transports laboratory animals. 7
(ii) Receives funds from this state, a local government, or an 8
agency or instrumentality of this state or a local government to 9
finance its operations through grants, loans, or other funds. 10
Enacting section 1. This amendatory act does not take effect 11
unless Senate Bill No. ____ (request no. S02817'25) or House Bill 12
No. 6167 (request no. H02817'25) of the 103rd Legislature is 13
enacted into law. 14
