HOUSE BILL NO. 6175

A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1280h.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1280h. (1) By not later than January 1, 2028, the 1
department shall develop a system of expanded accountability 2
measurements to provide additional information on public schools 3
designated as alternative education campuses. The department shall 4
designate a public school as an alternative education campus if the 5
public school meets at least 1 of the following: 6

(a) The public school is a strict discipline academy 1
established under section 1311b to 1311l. 2
(b) The public school operates a dropout recovery and 3
prevention program as described in section 23a of the state school 4
aid act of 1979, MCL 388.1623a. 5
(c) The public school exclusively operates as an adult 6
education program as described in section 107 of the state school 7
aid act of 1979, MCL 388.1707. 8
(d) The public school has previously been identified and 9
approved by the department as an alternative education campus or 10
received an alternative education emphasis from the center. 11
(2) By not later than June 30, 2028, and each June 30 12
thereafter, the department shall assign a rating of 0 to 100 to 13
each public school designated as an alternative education campus 14
under subsection (1). A rating assigned under this subsection must 15
be included in public-facing reports and must only be in comparison 16
with other public schools designated as alternative education 17
campuses. The rating assigned under this subsection must be based 18
on the criteria currently measured through the Michigan school 19
index in compliance with section 1111(c)(4)(D) of the elementary 20
and secondary education act of 1965, 20 USC 6311, and must be 21
determined as follows: 22
(a) Student growth must be the primary factor considered and 23
must receive a weight of at least 3 times that assigned to student 24
proficiency under subdivision (c) when determining a rating under 25
this subsection. 26
(b) Graduation rate must be the second factor considered when 27
determining a rating under this subsection. Graduation rate must be 28
assigned the same weight as student growth as described in 29

subdivision (a) when determining a rating under this subsection. 1
The consideration of an alternative education campus's graduation 2
rate under this subdivision must incorporate extended-year adjusted 3
cohort graduation rates, including cohorts of up to 8 years, 4
consistent with federal requirements. 5
(c) Student proficiency data must not consider data for 6
students until they have been enrolled in the alternative education 7
campus for a full academic year when determining a rating under 8
this subsection. Student proficiency data may be considered with 9
additional weight for students with extended enrollment of 2 or 10
more full academic years at the alternative education campus, 11
consistent with state and federal full academic year requirements. 12
(d) A rating assigned under this subsection for a public 13
school must include clearly defined and publicly reported weighting 14
of the criteria described in subdivision (a), (b), and (c) and the 15
following criteria: 16
(i) English learner progress. 17
(ii) Assessment participation rates. 18
(iii) School quality and student success. 19
(iv) Any other factors currently measured through the Michigan 20
school index. 21
(3) For each public school that receives a rating under 22
subsection (2), the department shall do both of the following: 23
(a) Describe all criteria considered toward the rating, 24
including those criteria under subsection (2) and any supplemental 25
criteria considered reasonably appropriate for alternative 26
education programs. 27
(b) Describe the process for, and the stakeholders involved 28
in, the design and implementation of the expanded accountability 29

model, including opportunities for stakeholder input. 1
(4) The rating provided under subsection (2) must include 2
expected performance levels for each measurement based on data 3
gathered by the department. The data gathered by the department 4
under this subsection must be exclusively from public schools 5
designated as alternative education campuses. 6
(5) The data publicly reported under subsection (2) must be 7
reported as alternative education campus data and separately from 8
public schools not designated as alternative education campuses. 9
Any comparison reports must include only alternative education 10
campus data. 11
(6) For any alternative education campus that is identified 12
for comprehensive support and improvement, targeted support and 13
improvement, or additional targeted support, under section 1111 of 14
the elementary and secondary education act of 1965, 20 USC 6311, 15
intervention plans must be aligned with the design and purpose of 16
alternative education programs and must incorporate evidence-based 17
strategies and methods appropriate for the populations served by 18
such programs. 19
(7) As used in this section: 20
(a) "Campus" means any physical, online, or hybrid school 21
setting as determined by the department. 22
(b) "Center" means the center for educational performance and 23
information created under section 94a of the state school aid act 24
of 1979, MCL 388.1694a. 25
