HOUSE BILL NO. 6181
A bill to amend 1995 PA 280, entitled
"An act to authorize local units of government to accept financial
transaction device payments,"
by amending section 1 (MCL 129.221), as amended by 2002 PA 256.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act: 1
(a) "Credit card" means a card or device issued by a any of 2
the following: 3
(i) A person licensed under 1984 PA 379, MCL 493.101 to 4
493.114. , or 5

(ii) A person licensed under the consumer financial services 1
act, 1988 PA 161, MCL 487.2051 to 487.2072. , or issued by a 2
(iii) For 6 months after the effective date of the residential 3
mortgage licensing and supervision act, a depository financial 4
institution, as that term is defined in section 1a of the mortgage 5
brokers, lenders, and servicers licensing act, 1987 PA 173, MCL 6
445.1651a, under a credit card arrangement. 7
(iv) Beginning on the effective date of the residential 8
mortgage licensing and supervision act, a depository institution, 9
as that term is defined in section 3 of the residential mortgage 10
licensing and supervision act, under a credit card arrangement. 11
(b) "Credit card arrangement" means an unsecured extension of 12
credit for purchasing goods or services from the credit card issuer 13
or any other person that is made to the holder of a credit card and 14
that is accessed with a credit card. 15
(c) "Financial transaction device" means any of the following: 16
(i) An electronic funds transfer card. 17
(ii) A credit card. 18
(iii) A debit card. 19
(d) "Governing body" means any of the following: 20
(i) The council, commission, or other entity vested with the 21
legislative power of a village. 22
(ii) The council or other entity vested with the legislative 23
power of a city. 24
(iii) The township board of a township. 25
(iv) The county board of commissioners of a county. 26
(v) The board of county road commissioners of a county. 27
(vi) The board of education of a local school district. 28

(vii) The board of education of an intermediate school 1
district. 2
(viii) The board of trustees of a community college district. 3
(ix) The official body to which is granted general governing 4
powers over an authority or organization of government established 5
by law which may issue obligations pursuant to under the revised 6
municipal finance act, 2001 PA 34, MCL 141.2101 to 141.2821, and 7
which may expend funds of the authority or organization. 8
(e) "Local school district" means a school district organized 9
under the revised school code, 1976 PA 451, MCL 380.1 to 380.1852, 10
or a district governed by a special or local act. 11
(f) "Local unit" means any of the following: 12
(i) A village. 13
(ii) A city. 14
(iii) A township. 15
(iv) A county. 16
(v) A county road commission. 17
(vi) A local school district. 18
(vii) An intermediate school district. 19
(viii) A community college district. 20
(ix) An authority or organization of government established by 21
law which may issue obligations under the revised municipal finance 22
act, 2001 PA 34, MCL 141.2101 to MCL 141.2821, and which may expend 23
funds of the authority or organization. 24
Enacting section 1. This amendatory act does not take effect 25
unless House Bill No. 6177 (request no. H05171'25) of the 103rd 26
Legislature is enacted into law. 27
