HOUSE BILL NO. 6206

A bill to amend 2020 PA 366, entitled
"An act to prohibit postsecondary educational institutions in this
state and certain athletic organizations from preventing a college
athlete from receiving compensation for the use of his or her name,
image, or likeness rights,"
(MCL 390.1731 to 390.1741) by adding section 6a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 6a. (1) A student athlete shall not enter into a contract 1
that provides compensation to the student athlete for the use of 2
the student athlete's name, image, or likeness if the contract does 3
any of the following: 4

(a) Remains in effect beyond the date the student athlete is 1
no longer eligible to participate in intercollegiate athletics. 2
(b) Requires the student athlete to provide either of the 3
following as consideration: 4
(i) Any compensation the student athlete may earn for the use 5
of the student athlete's name, image, or likeness beyond the date 6
the student athlete is no longer eligible to participate in 7
intercollegiate athletics. 8
(ii) The use of the student athlete's name, image, or likeness 9
beyond the date the student athlete is no longer eligible to 10
participate in intercollegiate athletics. 11
(c) Requires any litigation, arbitration, or other dispute 12
resolution process arising from the contract to occur in another 13
state. 14
(2) An athlete agent shall not enter into an agent contract 15
with a student athlete under which the athlete agent represents the 16
student athlete in relation to contracts or legal matters regarding 17
opportunities for the student athlete to earn compensation for the 18
use of the student athlete's name, image, or likeness if the agent 19
contract remains in effect beyond the date the student athlete is 20
no longer eligible to participate in intercollegiate athletics. 21
(3) An athlete agent shall not enter into a fee agreement that 22
requires the student athlete to provide as consideration either of 23
the following: 24
(a) Any compensation the student athlete may earn after the 25
student athlete is no longer eligible to participate in 26
intercollegiate athletics for use of the student athlete's name, 27
image, or likeness. 28
(b) Rights associated with the use of the student athlete's 29

name, image, or likeness after the student athlete is no longer 1
eligible to participate in intercollegiate athletics. 2
(4) A contract that provides a student athlete compensation 3
for the use of the student athlete's name, image, or likeness must 4
require any litigation, arbitration, or other dispute resolution 5
process arising from the contract to occur in this state and be 6
governed by this state's laws. 7
(5) The parties to a contract that provides a student athlete 8
with compensation for the use of the student athlete's name, image, 9
or likeness shall ensure that the contract complies with this 10
section. 11
(6) The parties to any contract involving a student athlete 12
who transfers from an educational institution located outside of 13
this state to a postsecondary educational institution shall ensure 14
that the contract complies with this section if both of the 15
following apply: 16
(a) The contract provides the student athlete with 17
compensation for the use of the student athlete's name, image, or 18
likeness. 19
(b) The contract is in effect on the date of the student 20
athlete's transfer to the postsecondary educational institution and 21
continues in effect at the student athlete's postsecondary 22
educational institution. 23
(7) A contract entered into in violation of this section is 24
void. 25
(8) As used in this section: 26
(a) "Athlete agent" means a person who, directly or 27
indirectly, recruits or solicits an individual to enter into an 28
agent contract or professional sport services contract, or who 29

procures, offers, promises, or attempts to obtain employment for an 1
individual with a professional sport team or as a professional 2
athlete. Athlete agent does not include a member of an individual's 3
immediate family. 4
(b) "Compensation" means money, thing of value, or financial 5
benefit. 6
(c) "Intercollegiate athletics" means a sport played at the 7
collegiate level for which eligibility requirements for 8
participation are established by an athletic association, 9
conference, or organization with authority over the associated 10
sport. 11
(d) "Name, image, and likeness" means an individual's name, 12
voice, signature, photograph, image, likeness, or distinctive 13
appearance, if any of these aspects have commercial value. 14
(e) "Student athlete" means an individual who engages in, is 15
eligible to engage in, or may be eligible to engage in any 16
intercollegiate sporting event, contest, exhibition, or program. 17
Student athlete does not include an individual who participates in 18
intramural athletics at a state institution of higher education or 19
private college or who participates in professional athletics. 20
