HOUSE BILL NO. 6220
A bill to amend 2023 PA 281, entitled
"Public officers financial disclosure act,"
by amending sections 3, 6, and 7 (MCL 15.703, 15.706, and 15.707),
sections 3 and 7 as amended and section 6 as added by 2025 PA 3.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3. As used in this act: 1
(a) "Blind trust" means a qualified blind trust or qualified 2
diversified trust as those terms are defined in 5 CFR 2634.403. 3
(b) "Consumer Price Index" means the most comprehensive index 4
of consumer prices available for the Detroit-Warren-Dearborn area 5
July 03, 2026, Introduced by Reps. Skaggs and Rheingans and referred to Committee on Election
Integrity.

(c) "Department" means the department of state. 3
(d) "Dependent" means an individual claimed by a public 4
officer or a public officer's spouse as a dependent for federal 5
income tax purposes. 6
(e) (d) "Earned income" means salaries, wages, tips, bonuses, 7
commissions, or other compensation or earnings from employment 8
earned during the reporting period. 9
(f) "Fair market value" means the value of an item or service 10
that is available to any member of the public at the time the item 11
or service is acquired. The value must be determined on the basis 12
of market prices for the item or service on the day the acquisition 13
occurs. Price fluctuations of the item or service that occurred 14
before or after the acquisition do not affect the fair market value 15
determination. 16
(g) (e) "Form" means the financial disclosure form provided 17
under section 6 and published by the department in accordance with 18
section 11. 19
(h) (f) "Gift" means any item a public officer receives that 20
is required to be reported by a lobbyist or lobbyist agent under 21
1978 PA 472, MCL 4.411 to 4.431.that term as defined in section 4 22
of 1978 PA 472, MCL 4.414. Notwithstanding section 4(1)(d) of 1978 23
PA 472, MCL 4.414, gift includes goods, beverages, travel-related 24
payments or reimbursements, and tickets. 25
(i) (g) "Honorarium" means that term as defined in section 7 26
of the Michigan campaign finance act, 1976 PA 388, MCL 169.207. 27
(j) (h) "Liabilities" means what a person owes to another 28
person, including, but not limited to, mortgages or other debts . 29

For purposes of this act, a debt does not include including a 1
revolving debt, an unsecured debt that is from a financial 2
institution or the federal government, or a debt owed by a business 3
entity. 4
(k) (i) "Lobbyist" means that term as defined in section 5 of 5
1978 PA 472, MCL 4.415. 6
(l) (j) "Lobbyist agent" means that term as defined in section 7
5 of 1978 PA 472, MCL 4.415. 8
(m) (k) "Public officer" means all of the following: 9
(i) A state representative. 10
(ii) A state senator. 11
(iii) The attorney general. 12
(iv) The governor. 13
(v) The lieutenant governor. 14
(vi) The secretary of state. 15
(vii) A member of the state board of education. 16
(viii) A regent of the University of Michigan. 17
(ix) A member of the board of trustees of Michigan State 18
University. 19
(x) A member of the board of governors of Wayne State 20
University. 21
(n) (l) "Report" means the financial disclosure report required 22
under section 10 of article IV of the state constitution of 1963. 23
The report must be in the form provided under section 6. 24
(o) (m) "Reporting period" means the preceding calendar year. 25
(p) (n) "Spouse" means an individual who is lawfully married 26
to a public officer as described under 26 CFR 301.7701-18. 27
(q) (o) "Unearned income" means income that is not earned from 28
employment, including, but not limited to, financial prize, 29

unemployment benefits, annuities, stock dividends, deferred 1
compensation, pension, profit sharing, or retirement income. 2
Unearned income does not include inheritance money or a familial 3
gift. 4

Sec. 7. (1) A report required under section 5 must include a 22
complete statement of all of the following: 23
(a) The full name, mailing address, telephone number, and 24
email address of the public officer. 25
(b) The name and address of the public officer's employer or 26
employers and the positions held during the reporting period, if 27
the public officer receives $1,000.00 or more in annual income from 28
each position. 29

(c) The name of the spouse of the public officer and, if the 1
public officer's spouse receives $1,000.00 or more in annual 2
income, the occupation of the public officer's spouse and the name 3
of the employer or employers of the public officer's spouse. 4
(d) Whether the public officer's spouse was registered as a 5
lobbyist or lobbyist agent under 1978 PA 472, MCL 4.411 to 4.431, 6
during the reporting period. 7
(e) A list of all positions currently held as an officer, 8
director, trustee, partner, proprietor, representative, employee, 9
or consultant of any organization, corporation, firm, partnership, 10
or other business enterprise, nonprofit organization, labor 11
organization, or educational or other institution other than this 12
state. If this subdivision applies, the public officer shall 13
include the name of the organization. For purposes of this 14
subdivision, positions held in any religious, social, fraternal, or 15
political entity, or positions that are solely of an honorary 16
nature, are excluded. 17
(f) The source of earned income received during the reporting 18
period by the public officer. For purposes of this subdivision, the 19
public officer must disclose each source of income received during 20
the reporting period that is $1,000.00 or more. 21
(g) Except as otherwise provided in this subdivision, a list 22
of each asset, excluding a business asset, held by the public 23
officer for investment or production of income with a fair market 24
value of $1,000.00 or more during the reporting period, each asset, 25
excluding a business asset, held by the public officer's spouse for 26
investment or production of income with a fair market value of 27
$50,000.00 or more during the reporting period, and any sources of 28
unearned income that exceed $200.00 during the reporting period, 29

including the origins and addresses of the sources of unearned 1
income. The fair market value for the purpose of listing each 2
asset, excluding a business asset, held for investment or 3
production of income under this subdivision must be adjusted for 4
inflation every 4 years using the Consumer Price Index, and rounded 5
up to the nearest $1,000.00. 6
(h) A list of all liabilities that exceed $10,000.00 owed by 7
the public officer to a creditor at any time during the reporting 8
period. 9
(i) Except as otherwise provided in this subdivision, a list 10
of any stocks, bonds, or other forms of securities held by the 11
public officer, the public officer's spouse, or held jointly with 12
the public officer's spouse during the reporting period, including 13
the origin and address of the security, if the security has a total 14
aggregate fair market value of $1,000.00 or more. The fair market 15
value for the purpose of listing stocks, bonds, or other forms of 16
securities under this subdivision must be adjusted for inflation 17
every 4 years using the Consumer Price Index, and rounded up to the 18
nearest $1,000.00. For purposes of this act, a public officer is 19
not required to disclose a stock within a widely held investment 20
fund, including, but not limited to, a mutual fund, regulated 21
investment company, pension or deferred compensation plan, or other 22
investment fund, if both of the following apply: 23
(i) Either the fund is publicly traded or the assets of the 24
fund are widely diversified. 25
(ii) The public officer or the public officer's spouse does not 26
exercise control over or have the ability to exercise control over 27
the financial interests held by the fund. 28
(j) A list of any real property in which the public officer or 29

public officer's spouse holds an ownership or other financial 1
interest. For purposes of this subdivision, the public officer is 2
required to include a real property in the report only if that real 3
property has a fair market value of $1,000.00 or more during the 4
reporting period. A public officer filing a report may exclude the 5
street number of a parcel of real property under this subdivision. 6
(k) A list of any cryptocurrencies held by the public officer 7
during the reporting period. 8
(l) (k) The date of, identity of parties to, and general terms 9
of any agreements or arrangements made or in effect during the 10
reporting period with respect to the following: 11
(i) Any future employment that would commence after the public 12
officer leaves office. 13
(ii) A leave of absence from any former or current employer 14
taken while serving as a public officer. 15
(iii) A continuation or deferral of payments by a former or 16
current employer other than this state to the public officer, or 17
the public officer's continuing participation in an employee 18
welfare or benefit plan maintained by a former employer. 19
(m) (l) A list of all gifts received and required to be 20
reported during the reporting period by a lobbyist or lobbyist 21
agent under state law, including the name of the lobbyist or 22
lobbyist agent that provided the gift. If the public officer 23
receives either of the following gifts from a lobbyist, the public 24
officer must report the fair market value of the gift: 25
(i) A ticket or offer of free or reduced-price attendance to a 26
charity event that has the primary purpose of raising money for a 27
nonprofit organization that is tax-exempt under section 501(c)(3) 28
of the internal revenue code, 26 USC 501. 29

(ii) Admission to a conference or educational event that is 1
connected to public business or the performance of the governmental 2
duties of the public officer. 3
(n) A list of all gifts with a value of $1,000.00 or more 4
received from an individual, partnership, corporation, association, 5
or other legal entity. 6
(o) (m) A list of all travel payments received and required 7
to be reported during the reporting period by a lobbyist or 8
lobbyist agent under state law, including the name of the lobbyist 9
or lobbyist agent that provided the travel payment. 10
(p) A list of all travel payments with a value of $1,000.00 or 11
more received by or made on behalf of the public officer from an 12
individual, partnership, corporation, association, or other legal 13
entity. 14
(q) (n) A list of each payment made by a lobbyist or lobbyist 15
agent during the reporting period to a charity in lieu of 16
honoraria, including the name of the lobbyist or lobbyist agent 17
that made the payment. 18
(r) (o) If applicable, a statement indicating that the public 19
officer or the public officer's spouse is a registered vendor with 20
this state, has a majority an interest of 10% or more in a company 21
that is a registered vendor with this state, or is employed by a 22
company that is a registered vendor with this state. If the public 23
officer or the public officer's spouse is a registered vendor with 24
this state or has a majority an interest of 10% or more in a 25
company that is a registered vendor with this state, the public 26
officer shall include the name of the company and a description of 27
all contracts entered into with this state by the public officer, 28
public officer's spouse, or company in which the public officer or 29

public officer's spouse has a majority an interest of 10% or more 1
during the reporting period. If the public officer or public 2
officer's spouse is employed by a company that is a registered 3
vendor with this state, the public officer shall include the name 4
of the company and a description of all contracts entered into with 5
this state that the public officer or the public officer's spouse 6
worked on directly during the reporting period. 7
(s) All of the following information related to each of the 8
public officer's dependents, referred to by the dependent's first 9
and last initial, as applicable: 10
(i) The number of dependents that the public officer or public 11
officer's spouse has. 12
(ii) If a dependent earns $50,000.00 or more from an employer 13
during the reporting period, the principal activity of that 14
employer. 15
(iii) Except as otherwise provided in this subparagraph, a list 16
of each asset, excluding a business asset, held by a dependent for 17
investment or production of income with a fair market value of 18
$50,000.00 or more during the reporting period. The fair market 19
value for the purpose of listing each asset, excluding a business 20
asset, held for investment or production of income under this 21
subdivision must be adjusted for inflation every 4 years using the 22
Consumer Price Index and rounded up to the nearest $1,000.00. 23
(iv) Except as otherwise provided in this subparagraph, a list 24
of any stocks, bonds, or other forms of securities held by a 25
dependent during the reporting period, including the origin and 26
address of the security, if the security has a total aggregate fair 27
market value of $50,000.00 or more. The fair market value for the 28
purpose of listing stocks, bonds, or other forms of securities 29

under this subdivision must be adjusted for inflation every 4 years 1
using the Consumer Price Index. For purposes of this subparagraph, 2
a public officer is not required to disclose a stock within a 3
widely held investment fund, including, but not limited to, a 4
mutual fund, regulated investment company, pension or deferred 5
compensation plan, or other investment fund, if the fund is 6
publicly traded or the assets of the fund are widely diversified. 7
(v) A description of any interest that a dependent had during 8
the reporting period in a legal entity that conducts business in 9
this state, including the name of the legal entity, if the interest 10
has a fair market value of $50,000.00 or more. 11
(2) A public officer is not required to disclose the value of 12
any disclosure under subsection (1). 13
(3) If a public officer required to file a report under this 14
section holds a beneficial interest in a blind trust, the public 15
officer is not required to include the interests or assets of the 16
blind trust in the report. However, the public officer must 17
indicate in the public officer's report that the public officer 18
holds a beneficial interest in a blind trust. For purposes of this 19
subsection, "beneficial interest" includes, but is not limited to, 20
the interest in a trust of a qualified trust beneficiary or trust 21
beneficiary as those terms are defined under section 7103 of the 22
estates and protected individuals code, 1998 PA 386, MCL 700.7103. 23
(4) A report required under section 5 must include the 24
following certification: "I certify that the statements I have made 25
on this financial disclosure form are true, complete, and correct 26
to the best of my knowledge and belief, and that I have not moved 27
assets during the reporting period for the purpose of avoiding 28
disclosure under the public officers financial disclosure act". 29
