SENATE BILL NO. 1034

A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3406xx.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3406xx. (1) Except as otherwise provided in this section, 1
an insurer that delivers, issues for delivery, or renews in this 2
state a health insurance policy shall not deny or limit coverage 3
for prescription inhalers to enable an individual to breathe when 4
suffering from asthma or other life-threatening bronchial ailments 5
based on any restriction on the number of days before an inhaler 6
June 10, 2026, Introduced by Senators GREENE and CAMILLERI and referred to Committee on
Health Policy.

refill may be obtained if, contrary to those restrictions, the 1
inhalants have been ordered or prescribed by the treating physician 2
and are medically appropriate. 3
(2) An insurer described in subsection (1) shall provide the 4
coverage required under subsection (1) at no cost to the insured. 5
(3) As used in this section, "prescription inhaler" means a 6
prescribed medical device that delivers inhaled medications used to 7
treat breathing for persons suffering from asthma or other life-8
threatening bronchial ailments. Prescription inhaler includes 9
metered-dose inhalers, nebulizers, and dry powder inhalers. 10
Prescription inhaler does not include an inhaler available over the 11
counter without a prescription to provide temporary relief from 12
respiratory symptoms. 13
