SENATE BILL NO. 1036

A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1233b (MCL 380.1233b), as amended by 2018 PA
235.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1233b. (1) Subject to subsection (2) and except as 1
provided in subsection (3), the board of a school district or 2
intermediate school district or the board of directors of a public 3
school academy may engage a full-time or part-time noncertificated, 4
June 11, 2026, Introduced by Senator CAMILLERI and referred to Committee on Education.

nonendorsed teacher to teach a course in computer science, a 1
foreign language, mathematics, biology, chemistry, engineering, 2
physics, robotics, or in another subject area determined by the 3
state board to be appropriate to be included under this section and 4
so designated by the state board, or any combination of these 5
subject areas, in grades 9 through to 12, or in an industrial 6
technology education program or a career and technical education 7
program. 8
(2) Subject to subsections (3) and (6), a noncertificated, 9
nonendorsed teacher is qualified to teach under this section if he 10
or she the noncertificated, nonendorsed teacher meets at least 1 of 11
the following minimum requirements: 12
(a) All of the following: 13
(i) Possesses an earned bachelor's degree from an accredited 14
postsecondary institution. 15
(ii) Has a major or a graduate degree in the field of 16
specialization in which he or she the noncertificated, nonendorsed 17
teacher will teach. 18
(iii) If the noncertificated, nonendorsed teacher desires to 19
teach for more than 1 year, has passed a subject area examination, 20
if a subject area examination exists, in the field of 21
specialization in which he or she the noncertificated, nonendorsed 22
teacher will teach. 23
(iv) Except in the case of individuals engaged to teach a 24
foreign language, has, in the 5-year period immediately preceding 25
the date of hire, not less than 2 years of occupational experience 26
in the field of specialization in which he or she the 27
noncertificated, nonendorsed will teach. 28
(b) For teaching a course in an industrial technology 29

education program or a career and technical education program, is 1
engaged to teach in a subject matter or field in which the 2
noncertificated, nonendorsed teacher has achieved expertise, as 3
determined by the board of a school district or intermediate school 4
district or board of directors of a public school academy, and 5
satisfies all of the following: 6
(i) Has a high school diploma or a high school equivalency 7
certificate as defined in section 4 of the state school aid act of 8
1979, MCL 388.1604. 9
(ii) For teaching in a subject matter or field in which a 10
professional license or certification is required, at least 1 of 11
the following: 12
(A) Holds a professional license or certification in that same 13
subject matter or field. 14
(B) Previously held a professional license or certification in 15
that same subject matter or field that expired no more than 2 years 16
before the noncertificated, nonendorsed teacher's initial 17
employment under this section and was in good standing immediately 18
before the license or certification expired. 19
(iii) Has at least 2 cumulative years of professional experience 20
in that same subject matter or field in the immediately preceding 21
10 years. 22
(3) The requirements listed in subsection (2) for a 23
noncertificated, nonendorsed teacher engaged to teach under this 24
section shall be are in addition to any other requirements 25
established by the board of a school district or intermediate 26
school district or board of directors of a public school academy, 27
as applicable. 28
(4) Except as provided in subsection (5), the board of a 29

school district or intermediate school district or board of 1
directors of a public school academy shall not engage a full-time 2
or part-time noncertificated, nonendorsed teacher to teach a course 3
described in subsection (1) if the district or public school 4
academy is able to engage a certificated, endorsed teacher. 5
(5) Subject to subsection (6), if the board of a school 6
district or intermediate school district or board of directors of a 7
public school academy is able to engage a certificated, endorsed 8
teacher to teach a course described in subsection (1), the board or 9
board of directors may employ or continue to employ a 10
noncertificated, nonendorsed teacher to teach the course if the 11
noncertificated, nonendorsed teacher meets at least 1 of the 12
following: 13
(a) Both of the following: 14
(i) The noncertificated, nonendorsed teacher is annually and 15
continually enrolled and completing credit in an approved teacher 16
preparation program leading to a provisional teaching certificate. 17
(ii) The noncertificated, nonendorsed teacher has a planned 18
program leading to teacher certification on file with the employing 19
school district or intermediate school district or public school 20
academy, his or her a teacher preparation institution, and the 21
department. 22
(b) Is engaged to teach in an industrial technology education 23
program or a career and technical education program and meets the 24
requirements under subsection (2)(b). 25
(6) The board of a school district or intermediate school 26
district or board of directors of a public school academy may 27
employ a noncertificated, nonendorsed teacher who meets the 28
requirements of subsection (2)(b) to teach in an industrial 29

technology education program or a career and technical education 1
program for up to 10 20 years. The superintendent of public 2
instruction may permit the board or board of directors to employ 3
the teacher for more than 10 years. 4
(7) If the noncertificated, nonendorsed teacher completes 3 5
years of successful classroom teaching, as determined by regular 6
observation and review by school district, intermediate school 7
district, or public school academy personnel and teacher 8
preparation institution personnel, the department and a teacher 9
preparation institution shall utilize the teaching experience of a 10
noncertificated, nonendorsed teacher for the purpose of waiving 11
student teaching as a condition for receiving a continued 12
employment authorization in the school district, intermediate 13
school district, or public school academy and a provisional 14
teaching certificate. 15
(8) An individual engaged to teach under this section is 16
subject to the requirements of sections 1526 and 1527. 17
