SENATE BILL NO. 1038

A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding sections 5525a and 5525b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 5525a. (1) A person or facility shall not store, handle, 1
load, unload, stockpile, or process bulk solid material for 2
transport or shipment unless the person or facility does all of the 3
following: 4
(a) Annually obtains a certificate of operation as described 5
June 11, 2026, Introduced by Senators GEISS, CHANG, SHINK and IRWIN and referred to
Committee on Natural Resources and Agriculture.

in section 5525b. 1
(b) Adheres to site standards described in subsection (3) and 2
operating plans for dust control and material storage and handling. 3
(c) Installs, operates, and maintains, according to the 4
manufacturer's specifications, permanent, continuous, federal 5
equivalent method (FEM) real-time PM10 monitors around the 6
perimeter of the facility that satisfy all of the following 7
criteria: 8
(i) During the first year of monitoring, not less than 4 9
monitors must be placed around the facility. Each monitor must face 10
1 of the 4 cardinal directions, north, south, east, and west, to 11
monitor for fugitive dust in the ambient air around the facility. 12
(ii) During the second year and all subsequent years of 13
monitoring, monitors must be placed in accordance with a fugitive 14
dust plan based on the data observed in the first year. This 15
includes 2 monitors located upwind and 2 monitors located downwind, 16
and additional monitors as appropriate depending on the size of the 17
facility and other relevant factors, such as the variability of 18
wind direction at the facility and the proximity of residential 19
neighborhoods. 20
(iii) A data logger must be attached to each monitor to record 21
readings, and the facility owner or operator shall notify the 22
department in writing within 24 hours of the occurrence of either 23
of the following events: 24
(A) A monitor reading exceeding a reportable action level. 25
(B) A malfunction of monitoring equipment preventing a reading 26
or logging of data. 27
(d) The facility owner or operator shall maintain a log of 28
each PM10 monitor's maintenance and calibration activities. 29

(e) The facility owner or operator shall install, operate, and 1
maintain, according to manufacturer's specifications, a weather 2
station or other permanent device to monitor and log wind speed and 3
wind direction at the facility at an unobstructed, unsheltered 4
area, centrally positioned in relation to the storage piles, and at 5
a minimum height of 10 meters above ground level. 6
(2) A person or facility that stores bulk solid material for 7
transfer or shipment shall do all of the following: 8
(a) Maintain each pile and transfer location in enclosed 9
storage. 10
(b) Ensure that each entrance or exit from enclosed storage 11
that allows passage of bulk solid material or vehicles has 12
overlapping flaps, sliding doors, or other devices approved by the 13
department that remain closed except when individuals are inside or 14
to allow vehicles to enter and leave or nonairborne material to be 15
moved into or out of enclosed storage. 16
(c) Ensure that any accumulation is all of the following: 17
(i) Enclosed and monitored by an air quality monitoring system. 18
(ii) Completely covered. 19
(iii) Inside enclosed storage or a conveyor, transport vehicle, 20
coker pit, slurry bin, water collection channel, or separation 21
pond. 22
(d) Post, in a conspicuous location at the site, all of the 23
following information: 24
(i) A copy of the person's or facility's completed certificate 25
of operation application. 26
(ii) A copy of the person's or facility's history of 27
infractions and noncompliance. 28
(3) A person or facility that stores bulk solid material shall 29

implement all of the following standards on the person's or 1
facility's property: 2
(a) Prohibit fugitive dust past the property line. 3
(b) Limit pile height for outdoor storage to 25 feet 4
generally, and to 15 feet for combustible material. 5
(c) Employ enclosures or water spray systems to control 6
fugitive dust at conveyors and transfer points. 7
(d) Maintain an 8 miles per hour speed limit. 8
(e) Require all outgoing vehicles to undergo both of the 9
following: 10
(i) A cleaning of loose materials. 11
(ii) A wheel wash or rumble strips. 12
(f) Require covered truck beds and trailers of all vehicles 13
carrying bulk solid material. 14
(g) Use wet street sweepers on paved roads inside the property 15
and not less than 1/4 mile outside of the property. 16
(h) Require that outdoor storage piles are set back not less 17
than 100 feet from a waterway, except that material in the process 18
of being unloaded from or loaded to a vessel may be located within 19
100 feet of a waterway for a period of time not to exceed 24 hours 20
so long as no materials are allowed to fall, erode, be thrown, 21
discharged, dumped, disposed of, or deposited in a waterway at any 22
time. When the temperature falls below 32 degrees Fahrenheit, the 23
facility shall use a chemical stabilizer or water heating system to 24
ensure that dust suppression continues. 25
(i) Establish enclosure requirements for carbonaceous bulk 26
solid material. 27
(4) Not more than 45 days after the effective date of the 28
amendatory act that added this section, the department shall issue 29

compliance orders setting forth schedules of interim steps to 1
ensure full compliance with subsection (3) not less than 180 days 2
after the effective date of the amendatory act that added this 3
section. The compliance orders must require monitoring and 4
reporting of pile sizes. The department shall promulgate rules in 5
accordance with industry best practices. 6
(5) As used in this section: 7
(a) "Accumulation" means any surface deposit of bulk solid 8
material that is in an amount greater than 3 ounces in 1 square 9
foot or higher than 3 inches. 10
(b) "Bulk solid material" means a solid substance or material 11
that can be used as a fuel or as an ingredient in a manufacturing 12
process and that may become airborne or be scattered by the wind, 13
including, but not limited to, ores, coal, and coke. Bulk solid 14
material does not include any of the following: 15
(i) Salt. 16
(ii) Grain. 17
(c) "Carbonaceous bulk solid material" means bulk solid 18
material that includes carbonaceous material. 19
(d) "Carbonaceous material" means a solid substance that 20
occurs naturally or exists as a result of a human-made process that 21
is rich in carbon. Carbonaceous material includes, but is not 22
limited to, petroleum coke, metallurgical coke, coke breeze, and 23
nut coke. 24
(e) "Coal" means a solid, brittle, carbonaceous rock 25
classified as anthracite, bituminous, subbituminous, or lignite by 26
ASTM International designation D388-77. 27
(f) "Coke" means a solid carbonaceous material derived from 28
the distillation of coal, including, but not limited to, 29

metallurgical coke, or from oil refinery coker units or other 1
cracking processes, including, but not limited to, petroleum coke. 2
(g) "Combustible material" means a substance that can catch 3
fire and burn. 4
(h) "Department" means the department of environment, Great 5
Lakes, and energy. 6
(i) "Enclosed storage" means a completely roofed and walled 7
structure. 8
(j) "Metallurgical coke" means a carbonaceous material 9
resulting from the manufactured purification of multifarious blends 10
of bituminous coal. 11
(k) "Petroleum coke" means a solid carbonaceous residue 12
produced from a coker after cracking and distillation from 13
petroleum refining operations, including, but not limited to, 14
residues produced by petroleum upgraders in addition to petroleum 15
refining. 16
(l) "Pile" means bulk solid material that attains a height of 3 17
feet or more, or a total surface area of 150 square feet or more. 18
(m) "Reportable action level" means the positive difference 19
between the level of PM10 measured at the upwind monitor or 20
monitors at a facility and the level of PM10 measured at the 21
downwind monitor or monitors at a facility that will trigger 22
response activities under a fugitive dust plan. The reportable 23
action level is the difference of 20% based on the concentration of 24
PM10 detected at the downwind monitor or monitors at a facility. 25
(n) "Transfer location" means the location in the storage, 26
handling, or transport process where bulk solid material being 27
moved is dropped or deposited. 28
(o) "24-hour emergency contact information" means the name, 29

number, and email of the facility owner or operator or the facility 1
owner or operator's designee that can be reached at any time. 2
Sec. 5525b. (1) Not more than 90 days after the effective date 3
of the amendatory act that added this section, a person or facility 4
regulated by this section shall file an application for a 5
certificate of operation on a form provided by the department. An 6
application for a certificate of operation must include all of the 7
following: 8
(a) The contact information of the applicant, including the 9
applicant's address, phone number, email address, and 24-hour 10
emergency contact information. 11
(b) The name and address of the applicant's facility. 12
(c) A nonrefundable application fee. 13
(d) A fugitive dust plan under subsection (4). 14
(e) Information required for a fugitive dust plan. 15
(f) An attestation, signed by the applicant, that the 16
applicant has read section 5525a and this section. 17
(g) Any other data or information the department requires. 18
(h) A history of the applicant's infractions and 19
noncompliance. 20
(2) Once an applicant submits a completed application under 21
subsection (1), the department shall review the completed 22
application and grant the applicant a certificate of operation if 23
the department determines that the applicant is compliant with 24
section 5525a, this section, and other applicable laws. 25
(3) The department shall deny an application if the 26
application is incomplete or the application demonstrates that the 27
applicant is noncompliant with section 5525a, this section, or 28
other applicable laws. 29

(4) A person or facility regulated by this section shall file 1
a fugitive dust plan with the person's or facility's application 2
for a certificate of operation. A fugitive dust plan must include 3
all of the following: 4
(a) The name and address of the person's or facility's 5
property. 6
(b) The contact information of the person responsible for 7
implementing the fugitive dust plan, including the person's phone 8
number, email address, and 24-hour emergency contact information. 9
(c) A site map, drawn to scale, including all of the following 10
information about the person's or facility's property: 11
(i) The property boundaries. 12
(ii) All buildings, internal roadways, and utilities on the 13
facility property. 14
(iii) All roadways and transportation corridors within 1/4 mile 15
of the person's or facility's property that are used for the 16
transport of bulk solid material to or from the person's or 17
facility's property. 18
(iv) The location of all floor drains, storm drains, waterways, 19
and storm water outfalls. 20
(v) All potential emission points at the person's or 21
facility's property, including a depiction of the footprints of all 22
bulk solid material piles, transfer points, and conveyors. 23
(vi) The location of all fugitive dust control devices and 24
monitoring devices, including, but not limited to, the fugitive 25
dust monitor and wind monitor. 26
(d) A description of the person's or facility's operations, 27
including a list of all incoming or outgoing bulk solid material 28
handled or processed at the person's or facility's property. 29

(e) A description of the truck routes on the person's or 1
facility's property that are used to transport bulk solid material 2
to and from the person's or facility's property, including an 3
explanation of how fugitive dust will be minimized during transport 4
and a list of the measures that will be used to ensure vehicles 5
used for transport are cleaned of loose material before the 6
vehicles leave the person's or facility's property. 7
(f) A calculation demonstrating the person's or facility's 8
property's maximum outdoor bulk solid material capacity in tons or 9
cubic yards. The calculation must be certified by the signature of 10
the person's or facility's property owner or operator or an 11
authorized representative of the facility's owner or operator. The 12
signature must be accompanied by evidence of the authority to sign 13
on behalf of the person's or facility's property owner or operator 14
if the signature belongs to an authorized representative. 15
(g) A description of all of the following: 16
(i) The control measures, devices, and technologies that a 17
person or facility uses to control fugitive dust. 18
(ii) How the person or facility will maintain all control 19
measures, devices, and technologies under subparagraph (i). 20
(iii) The training provided to staff regarding the proper 21
application and operation of the control measures, devices, and 22
technologies under subparagraph (i). 23
(h) A dust monitoring plan that includes all of the following: 24
(i) A description of the type, placement, operation, and 25
maintenance of PM10 monitors. 26
(ii) A schedule of quarterly testing to ensure compliance with 27
this section. 28
(iii) A description of the person's or facility's recordkeeping 29

system, which must include a schedule for routine inspection, 1
testing, and maintenance. 2
