SENATE BILL NO. 1040
A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1233b (MCL 380.1233b), as amended by 2018 PA
235.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1233b. (1) Subject to subsection (2) and except as 1
provided in subsection (3), the board of a school district or 2
intermediate school district or the board of directors of a public 3
school academy may engage a full-time or part-time noncertificated, 4

nonendorsed teacher to teach a course in computer science, a 1
foreign language, mathematics, biology, chemistry, engineering, 2
physics, robotics, or in another subject area determined by the 3
state board to be appropriate to be included under this section and 4
so designated by the state board, or any combination of these 5
subject areas, in grades 9 through to 12, or in an industrial 6
technology education program or a career and technical education 7
program. 8
(2) Subject to subsections (3) and (6), a noncertificated, 9
nonendorsed teacher is qualified to teach under this section if he 10
or she meets at least 1 of the following minimum requirements: 11
(a) All of the following: 12
(i) Possesses an earned bachelor's degree from an accredited 13
postsecondary institution. 14
(ii) Has a major or a graduate degree in the field of 15
specialization in which he or she will teach. 16
(iii) If the noncertificated, nonendorsed teacher desires to 17
teach for more than 1 year, has passed a subject area examination, 18
if a subject area examination exists, in the field of 19
specialization in which he or she will teach. 20
(iv) Except in the case of individuals engaged to teach a 21
foreign language, has, in the 5-year period immediately preceding 22
the date of hire, not less than 2 years of occupational experience 23
in the field of specialization in which he or she will teach. 24
(b) For teaching a course in an industrial technology 25
education program or a career and technical education program, is 26
engaged to teach in a subject matter or field in which the 27
noncertificated, nonendorsed teacher has achieved expertise, as 28
determined by the board of a school district or intermediate school 29

district or board of directors of a public school academy, and 1
satisfies all of the following: 2
(i) Has a high school diploma or a high school equivalency 3
certificate as defined in section 4 of the state school aid act of 4
1979, MCL 388.1604. 5
(ii) For teaching in a subject matter or field in which a 6
professional license or certification is required, at least 1 of 7
the following: 8
(A) Holds a professional license or certification in that same 9
subject matter or field. 10
(B) Previously held a professional license or certification in 11
that same subject matter or field that expired no more than 2 years 12
before the noncertificated, nonendorsed teacher's initial 13
employment under this section and was in good standing immediately 14
before the license or certification expired. 15
(iii) Has at least 2 cumulative years of professional experience 16
in that same subject matter or field in the immediately preceding 17
10 years. 18
(3) The requirements listed in subsection (2) for a 19
noncertificated, nonendorsed teacher engaged to teach under this 20
section shall be are in addition to any other requirements 21
established by the board of a school district or intermediate 22
school district or board of directors of a public school academy, 23
as applicable. 24
(4) Except as provided in subsection (5), the board of a 25
school district or intermediate school district or board of 26
directors of a public school academy shall not engage a full-time 27
or part-time noncertificated, nonendorsed teacher to teach a course 28
described in subsection (1) if the district or public school 29

academy is able to engage a certificated, endorsed teacher. 1
(5) Subject to subsection (6), if the board of a school 2
district or intermediate school district or board of directors of a 3
public school academy is able to engage a certificated, endorsed 4
teacher to teach a course described in subsection (1), the board or 5
board of directors may employ or continue to employ a 6
noncertificated, nonendorsed teacher to teach the course if the 7
noncertificated, nonendorsed teacher meets at least 1 of the 8
following: 9
(a) Both of the following: 10
(i) The noncertificated, nonendorsed teacher is annually and 11
continually enrolled and completing credit in an approved teacher 12
preparation program leading to a provisional teaching certificate. 13
(ii) The noncertificated, nonendorsed teacher has a planned 14
program leading to teacher certification on file with the employing 15
school district or intermediate school district or public school 16
academy, his or her teacher preparation institution, and the 17
department. 18
(b) Is engaged to teach in an industrial technology education 19
program or a career and technical education program and meets the 20
requirements under subsection (2)(b). 21
(6) The board of a school district or intermediate school 22
district or board of directors of a public school academy may 23
employ a noncertificated, nonendorsed teacher who meets the 24
requirements of subsection (2)(b) to teach in an industrial 25
technology education program or a career and technical education 26
program for up to 10 years. The superintendent of public 27
instruction may permit the board or board of directors to employ 28
the teacher for more than 10 years.The board of a school district 29

or intermediate school district or board of directors of a public 1
school academy may continue to employ a noncertificated, 2
nonendorsed teacher described in this subsection for more than 10 3
years with approval from any of the following, as applicable: 4
(a) The superintendent of public instruction. 5
(b) The superintendent of the intermediate school district 6
that employs the noncertificated, nonendorsed teacher. 7
(c) The superintendent of the local education agency that 8
employs the noncertificated, nonendorsed teacher. 9
(7) If the noncertificated, nonendorsed teacher completes 3 10
years of successful classroom teaching, as determined by regular 11
observation and review by school district, intermediate school 12
district, or public school academy personnel and teacher 13
preparation institution personnel, the department and a teacher 14
preparation institution shall utilize the teaching experience of a 15
noncertificated, nonendorsed teacher for the purpose of waiving 16
student teaching as a condition for receiving a continued 17
employment authorization in the school district, intermediate 18
school district, or public school academy and a provisional 19
teaching certificate. 20
(8) An individual engaged to teach under this section is 21
subject to the requirements of sections 1526 and 1527. 22
