SENATE BILL NO. 312

A bill to amend 1973 PA 116, entitled
"An act to provide for the protection of children through the
licensing and regulation of child care organizations; to provide
for the establishment of standards of care for child care
organizations; to prescribe powers and duties of certain
departments of this state and adoption facilitators; to provide
penalties; and to repeal acts and parts of acts,"
(MCL 722.111 to 722.128) by adding section 12a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 12a. (1) No later than 90 days after the effective date 1
of the amendatory act that added this section, the department shall 2

Human Services.

establish a process by which a child care center, group child care 1
home, or family child care home may request a review and appeal of 2
a determination by the department that the child care center, group 3
child care home, or family child care home violated a rule 4
promulgated under this act and the violation does not result in a 5
denial, revocation, or refusal to renew the license of a child care 6
center, group child care home, or family child care home under this 7
act or an injunction under section 13. 8
(2) The process established under subsection (1) must be in 9
writing and posted publicly on the department's website. 10
