SENATE BILL NO. 901
A bill to require that covered materials that were produced in
the United States be procured for certain projects; to provide for
waivers; and to provide for the powers and duties of certain state
governmental officers and entities.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act: 1
(a) "Covered materials" means cement, concrete, or steel. 2
(b) "Covered project" means an infrastructure, transportation, 3
housing, school, or public facility project that receives money 4
from this state. 5

(c) "Department" means the department of technology, 1
management, and budget. 2
(d) "State agency" means a department or agency in the 3
executive branch of state government. 4
Sec. 3. Subject to section 5, a person shall not procure 5
covered materials for a covered project unless the covered 6
materials are produced in the United States. Covered materials are 7
considered to have been produced in the United States if all 8
components of the covered materials that were not produced in the 9
United States constitute less than 5% of the total cost of the 10
covered materials. 11
Sec. 5. (1) A state agency may grant a waiver to the 12
requirements of section 3 if the state agency determines that any 13
of the following conditions are met: 14
(a) There are no covered materials available that meet the 15
requirements of section 3. 16
(b) The procurement of covered materials that meet the 17
requirements of section 3 would increase the cost of the covered 18
project by more than 25%. 19
(c) An emergency exists that requires the immediate 20
procurement of covered materials for a covered project and covered 21
materials that meet the requirements of section 3 cannot be 22
procured immediately. 23
(2) Not later than 30 days after a state agency grants a 24
waiver under subsection (1), the state agency shall publish a copy 25
of the waiver on its website. 26
(3) The department shall provide guidance to all procurement 27
officials in the executive branch of state government and update 28
the department's procurement policies to include a bid preference 29

for projects that commit to using products manufactured in this 1
state. 2
Sec. 7. (1) If another law applies to the procurement of 3
covered materials for a covered project, and if this act conflicts 4
with that law, this act applies to the procurement of the covered 5
materials to the extent that it does not conflict with that law. 6
(2) This act applies to the procurement of covered materials 7
beginning on January 1, 2030. 8
