SENATE BILL NO. 930
A bill to amend 1995 PA 30, entitled
"Electric transmission line certification act,"
by amending section 8 (MCL 460.568), as amended by 2004 PA 198.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 8. (1) Upon On applying for a certificate, the an 1
electric utility, affiliated transmission company, or independent 2
transmission company shall give public notice in the manner and 3
form the commission prescribes of an opportunity to comment on the 4
application, . Notice shall be including all of the following: 5
(a) A letter sent by mail to all of the following: 6
April 23, 2026, Introduced by Senators SINGH and BAYER and referred to Committee on Energy
and Environment.

(i) Each municipality and landowner with property located along 1
the proposed and alternate routes identified in the application for 2
the proposed major transmission line. 3
(ii) Each municipality and landowner with property located 4
within 1 mile of the centerline of the right-of-way for the 5
proposed and alternate routes identified in the application for the 6
proposed major transmission line. 7
(iii) Each municipality and landowner with property located in 8
the geographic area between the proposed and alternate routes 9
identified for the proposed major transmission line. 10
(b) The letter under subdivision (a) must include all of the 11
following: 12
(i) The case number of the docket established for the proposed 13
major transmission line, including instructions on how the person 14
can sign up through the commission's website to receive 15
notifications about the docket. 16
(ii) A highlighted map of the proposed and alternate routes 17
identified in the application. 18
(iii) If the transmission line is more than 5 miles in length, a 19
highlighted map of the geographic area within a 1-mile radius of 20
the proposed and alternate routes, as well as the land between the 21
routes. 22
(iv) The name, address, telephone number, and email address for 23
a dedicated contact person who has knowledge of the development of 24
the proposed major transmission line who is authorized to 25
communicate on behalf of the electric utility, affiliated 26
transmission company, or independent transmission company. 27
(v) Detail regarding the specific type of information the 28
electric utility, affiliated transmission company, or independent 29

transmission company is seeking from the landowners and 1
municipalities, including, but not limited to, the following: 2
(A) Particular characteristics about the landowner's property. 3
(B) Land use. 4
(C) Features of historical or environmental significance. 5
(vi) Rights the electric utility, affiliated transmission 6
company, or independent transmission company is potentially seeking 7
from the landowner. 8
(c) Public notice published in a newspaper of general 9
circulation in the area to be affected within a reasonable time 10
period after an application is provided to the commission. and 11
shall be sent to each affected municipality and each affected 12
landowner on whose property a portion of the proposed major 13
transmission line will be constructed. The notice shall must be 14
written in plain, nontechnical, and easily understood terms and 15
shall contain a title that includes the name of the electric 16
utility, affiliated transmission company, or independent 17
transmission company and the words "NOTICE OF INTENT TO CONSTRUCT A 18
MAJOR TRANSMISSION LINE". 19
(2) The commission shall conduct a proceeding on the 20
application as a contested case under the administrative procedures 21
act of 1969, 1969 PA 306, MCL 24.201 to 24.328. Upon On receiving 22
an application for a certificate, each affected municipality and 23
each affected landowner shall be is granted full intervenor status 24
as of right in commission proceedings concerning the proposed major 25
transmission lines. 26
(3) The commission may assess certificate application fees 27
from the electric utility, affiliated transmission company, or 28
independent transmission company to cover the commission's 29

administrative costs in processing the application and may require 1
the electric utility, affiliated transmission company, or 2
independent transmission company to hire consultants chosen by the 3
commission to assist the commission in evaluating those any issues 4
the application raises. 5
(4) The commission shall grant or deny the application for a 6
certificate not later than 1 year after the application's filing 7
date. If a party submits an alternative route for the proposed 8
major transmission line, the commission shall grant the application 9
for either the electric utility's, affiliated transmission 10
company's, or independent transmission company's proposed route or 11
1 alternative route or shall deny the application. The commission 12
may condition its approval upon on the applicant electric utility, 13
affiliated transmission company, or independent transmission 14
company taking additional action to assure the public convenience, 15
health, and safety and reliability of the proposed major 16
transmission line. 17
(5) The commission shall grant the application and issue a 18
certificate if it the commission determines all of the following: 19
(a) The quantifiable and nonquantifiable public benefits of 20
the proposed major transmission line justify its construction. 21
(b) The proposed or alternative route is feasible and 22
reasonable. 23
(c) The proposed major transmission line does not present an 24
unreasonable threat to public health or safety. 25
(d) The applicant electric utility, affiliated transmission 26
company, or independent transmission company has accepted the 27
conditions contained in a conditional grant. 28
(6) A certificate issued under this section shall must 29

identify the major transmission line's route and shall contain an 1
estimated cost for the transmission line. 2
(7) If construction of a proposed major transmission line is 3
not begun within 5 years of after the date that a certificate is 4
granted, the certificate is invalid and a new certificate shall be 5
is required for the proposed major transmission line. 6
