SENATE BILL NO. 946
A bill to amend 1973 PA 116, entitled
"An act to provide for the protection of children through the
licensing and regulation of child care organizations; to provide
for the establishment of standards of care for child care
organizations; to prescribe powers and duties of certain
departments of this state and adoption facilitators; to provide
penalties; and to repeal acts and parts of acts,"
(MCL 722.111 to 722.128) by adding section 13b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 13b. (1) The department shall establish and administer 1
the child care payment program to provide financial assistance to a 2
qualified child care provider. 3

(2) The child care payment fund is created as a restricted 1
fund in the department of treasury to be used solely for the 2
administration of the program. 3
(3) The state treasurer shall credit to the fund all amounts 4
appropriated to the fund and any other money made available to the 5
fund from any other source for the purposes under this act. The 6
state treasurer may solicit and accept gifts, grants, labor, loans, 7
and other aid from any person, government, or entity. The state 8
treasurer may receive money or other assets from any source for 9
deposit into the fund, including, but not limited to, federal 10
funds, gifts, bequests, and donations. 11
(4) Money deposited in the fund must be available for 12
distribution by not later than January 1 of the calendar year 13
following the distribution. The fund must not be used to meet state 14
match requirements for federal aid or block grants. 15
(5) Money in the fund at the close of the fiscal year remains 16
in the fund and does not lapse. 17
(6) Money available in the fund must not be expended without a 18
specific appropriation. 19
(7) The department shall administer the fund for auditing 20
purposes and expend money from the fund for the purpose of 21
administering this section. 22
(8) The department shall distribute money in the fund to 23
provide a bonus payment to qualified child care providers based on 24
the number and age of eligible children in the child development 25
and care program. Children who are older than 36 months of age must 26
be assessed at the base bonus payment rate. Children who are 36 27
months of age or younger must be assessed at a rate that is double 28
the base bonus payment rate. The department shall evaluate the 29

number of children served under the child development and care 1
program on October 1 of each year. The department shall determine 2
the number of children served under the child development and care 3
program based on the unduplicated count of children served in the 6 4
preceding payment periods before the department's evaluation on 5
October 1. 6
(9) As used in this section: 7
(a) "Department" means the department of lifelong education, 8
advancement, and potential. 9
(b) "Fund" means the child care payment fund created under 10
this section. 11
(c) "Program" means the child care payment program established 12
under this section. 13
(d) "Qualified child care provider" means a child care center, 14
group child care home, or family child care home that has billed 15
the department of lifelong education, advancement, and potential 16
for child care services under the child development and care 17
program within the preceding 6 months after the date the department 18
distributes money under the program. 19
Enacting section 1. This amendatory act does not take effect 20
unless Senate Bill No. 945 of the 103rd Legislature is enacted into 21
law. 22
