SENATE BILL NO. 958

A bill to amend 1993 PA 354, entitled
"Railroad code of 1993,"
(MCL 462.101 to 462.451) by adding section 352.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 352. (1) Except as provided in subsections (2) and (3), a 1
railroad shall not operate a train engaged in transporting freight 2
unless the train is operated by a crew of not fewer than 2 3
individuals. 4
(2) Subsection (1) does not apply under either of the 5
following circumstances: 6

(a) Operating a locomotive in hostler service. 1
(b) Operating a locomotive in helper service. 2
(3) Subsection (1) does not apply if a federal statute or 3
regulation is in effect requiring a train engaged in transporting 4
freight in this state to have a crew of not fewer than 2 5
individuals. 6
(4) As used in this section: 7
(a) "Helper service" means assisting a train that is 8
experiencing a mechanical failure or that is ascending or 9
descending a grade by coupling a locomotive to the front or rear of 10
the train. 11
(b) "Hostler service" means moving a train or locomotive a 12
short distance within a railroad yard or mechanical facility. 13
(c) "Train" means 1 or more locomotives coupled with 1 or more 14
freight cars. 15
