SENATE BILL NO. 975

A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3406mm.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3406mm. (1) The director shall contract with the exchange 1
established by the Michigan health insurance exchange act to 2
certify qualified health plans and qualified dental plans. 3
(2) The director shall by rule establish criteria for 4
certifying qualified health plans and qualified dental plans under 5
federal law. 6

(3) This section does not limit the authority of the director 1
to regulate the business of insurance within this state or to 2
exempt qualified health plans and qualified dental plans from 3
compliance with all applicable provisions of federal or state law. 4
(4) As used in this section: 5
(a) "Qualified dental plan" means that term as defined in 6
section 103 of the Michigan health insurance exchange act. 7
(b) "Qualified health plan" means that term as defined in 8
section 1261. 9
Enacting section 1. This amendatory act does not take effect 10
unless Senate Bill No. 973 of the 103rd Legislature is enacted into 11
law. 12
