SENATE BILL NO. 985

A bill to amend 2006 PA 110, entitled
"Michigan zoning enabling act,"
by amending section 201 (MCL 125.3201).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 201. (1) A Except as otherwise provided in this section, 1
a local unit of government may provide by zoning ordinance for the 2
regulation of land development and the establishment of 1 or more 3
districts within its zoning jurisdiction which that regulate the 4
use of land and structures to meet the needs of the this state's 5
citizens for food, fiber, energy, and other natural resources, 6

places of residence, recreation, industry, trade, service, and 1
other uses of land, to ensure that use of the land is situated in 2
appropriate locations and relationships, to limit the inappropriate 3
overcrowding of land and congestion of population, transportation 4
systems, and other public facilities, to facilitate adequate and 5
efficient provision for transportation systems, sewage disposal, 6
water, energy, education, recreation, and other public service and 7
facility requirements, and to promote public health, safety, and 8
welfare. 9
(2) Except as otherwise provided under this act, the 10
regulations shall must be uniform for each class of land or 11
buildings, dwellings, and structures within a district. 12
(3) A Except as otherwise provided in this section, a local 13
unit of government may provide under the zoning ordinance for the 14
regulation of land development and the establishment of districts 15
which that apply only to land areas and activities involved in a 16
special program to achieve specific land management objectives and 17
avert or solve specific land use problems, including the regulation 18
of land development and the establishment of districts in areas 19
subject to damage from flooding or beach erosion. 20
(4) A Except as otherwise provided in this section, a local 21
unit of government may adopt land development regulations under the 22
zoning ordinance designating or limiting the location, height, 23
bulk, number of stories, uses, and size of dwellings, buildings, 24
and structures that may be erected or altered, including tents and 25
recreational vehicles. 26
(5) Beginning on the effective date of the amendatory act that 27
added this subsection and ending 2 years after the effective date 28
of the amendatory act that added this subsection, a local unit of 29

government shall not adopt or enforce a zoning ordinance under this 1
act that regulates land development for residential use. 2
