SENATE BILL NO. 996

A bill to regulate access to social media companies by minors;
to provide for the powers and duties of certain state governmental
officers and entities; and to prescribe civil sanctions.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act may be cited as the "regulating access to 1
social media companies by minors act". 2
Sec. 2. As used in this act: 3
(a) "Social media company" means a person that is an 4
interactive computer service and that provides a social media 5
platform. 6

(b) "Social media platform" means a website or internet 1
application that a social media company makes available for an 2
individual to create an account to communicate with other account 3
holders and users through posts. Social media platform does not 4
include any of the following: 5
(i) Broadband internet access service as that term is defined 6
in 47 CFR 8.1. 7
(ii) Email. 8
(iii) An online service, application, or website if both of the 9
following apply: 10
(A) Content is preselected by the provider and is not 11
generated by account holders. 12
(B) Interactive functionality is incidental to, directly 13
related to, or dependent on, the preselected content described in 14
sub-subparagraph (A). 15
Sec. 3. (1) Beginning on the effective date of this act, a 16
social media company shall not allow an individual who is under 16 17
years of age to view or access a social media platform or to create 18
or maintain an account on a social media platform. 19
(2) Beginning on the effective date of this act, a social 20
media company shall not allow an individual who is 16 years of age 21
or older but less than 18 years of age to view or access a social 22
media platform or to create or maintain an account on a social 23
media platform without the express written consent of the 24
individual's parent or legal guardian. 25
Sec. 5. If a social media company violates this act, the 26
attorney general may bring a civil action against that social media 27
company seeking a civil fine of $25,000.00 per day that the social 28
media company violates this act. 29
