relating to housing; requiring certification prior to receiving funding from the
Minnesota Housing Finance Agency; proposing coding for new law in Minnesota
Statutes, chapter 462A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.

[462A.052] CERTIFICATES OF ELIGIBILITY FOR FUNDING.

(a) The commissioner shall not pay any monies, award any grant or loan, or allocate any
housing tax credits to a private entity unless the private entity possesses a current certificate
of eligibility for funding issued pursuant to this section.

(b) For the purposes of this section, "private entity" means any person or private group,
organization, proprietorship, partnership, trust, cooperative, corporation, or other commercial
or nonprofit entity, including an officer, employee, or agent thereof.

(c) An applicant for a certificate of eligibility for funding must provide:

(1) proof of compliance with any applicable requirement to register with the secretary
of state;

new text begin
(2) the street address, including the zip code, of its chief executive office and of one
office in this state, if there is one;

new text begin
(3) the entity's federal taxpayer identification number and, if available, a Minnesota tax
identification number; and

(4) a list of the private entity's employees along with an executed criminal history consent
form from each employee.

(d) After review of the application materials under paragraph (c), the commissioner may
provide a certificate of eligibility for funding.

(e) A certificate of eligibility for funding must expire no later than two years from its
issuance. After the expiration period, a private entity may reapply to the commissioner for
a new certificate of eligibility. The commissioner may revoke a certificate of eligibility for
funding if the commissioner finds that:

(1) the private entity included false information in its application for a certificate of
eligibility for funding;

(2) the private entity was not eligible for a certificate of eligibility for funding at the
time the certificate was issued; or

(3) the private entity misused public funds.
