A bill for an act

relating to children and families; directing the commissioner of children, youth,

and families to request a federal waiver to prohibit the purchase of certain items

with SNAP benefits.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

No later than January 1, 2027, the commissioner of

children, youth, and families shall submit to the United States Department of Agriculture

a demonstration waiver request under Code of Federal Regulations, title 7, section 282.1,

to prohibit the purchase of candy, energy drinks, and soda with federal Supplemental

Nutrition Assistance Program benefits.

(a) For purposes of this section, the following terms have the

meanings given.

(b) "Candy" means a product that involves the preparation of sugar or artificial sweeteners

in combination with chocolate, fruits, nuts, caramels, gummies, or hard candies or other

ingredients or flavorings in the form of bars, drops, or pieces.

(c) "Energy drink" means a beverage containing at least 65 milligrams of caffeine per

eight fluid ounces that is advertised as being specifically designed to provide metabolic

stimulation or an increase to the consumer's mental or physical energy. Energy drink does

not include coffee or tea or any substantially coffee- or tea-based beverage.

(d) "Soda" means a beverage made with carbonated water and flavored or sweetened

with added sugar or artificial sweeteners such as corn sweetener, corn syrup, dextrose,

fructose, glucose, high fructose corn syrup, lactose, malt syrup, maltose, molasses, raw

sugar, or sucrose. Soda does not include carbonated water that is plain or naturally flavored

or any beverage that is greater than 50 percent vegetable or fruit juice by volume, or that

contains less than five grams of added sugar.
