A bill for an act

relating to local government; prohibiting certain contracts to provide detention

facilities for federal immigration purposes; proposing coding for new law in

Minnesota Statutes, chapter 471.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Definitions.

(a) For the purposes of this section, the terms in this

subdivision have the meanings given them.

(b) "Federal government" means an agency, department, or other body of the United

States government, or an entity operating under contract with an agency, department, or

other body of the United States government.

(c) "Local government" means a county, home rule charter or statutory city, or joint

powers entity that includes a county or home rule charter or statutory city.

Prohibition.

Notwithstanding any law to the contrary, a local government must

not enter into an agreement with the federal government to provide facilities to receive a

person into custody when the basis for detention is a civil violation of federal immigration

law. An agreement prohibited under this section, whether entered into before or after the

effective date of this section, is void.
