A bill for an act

relating to transportation; establishing a temporary exception for certain duplicate

driver's license and Minnesota identification card charges following arrest or

detention; appropriating money; amending Minnesota Statutes 2024, section 171.06,

by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 171.06, is amended by adding a subdivision

to read:

(a) For an applicant who submits a declaration

under paragraph (b), the commissioner must not impose a fee for a duplicate license or

Minnesota identification card, including a surcharge and a filing fee under subdivision 2

and a filing fee under section 171.061, subdivision 4.

(b) To be eligible under paragraph (a), an applicant must provide a declaration that the

applicant:

(1) was arrested or detained by a peace officer or a federal agent within the meaning of

the definition in section 626.77, subdivision 3; and

(2) has lost possession of the applicant's license or Minnesota identification card as a

result of the arrest or detention.

(c) The exception in this subdivision applies to the first instance of a duplicate license

or Minnesota identification card issued to an applicant on or after October 1, 2026, and

before February 1, 2029.

DUPLICATE LICENSE OR MINNESOTA IDENTIFICATION CARD; FEE

REFUNDS.

(a) By December 31, 2026, the commissioner of public safety must issue a refund

payment to each individual who obtained a duplicate driver's license or Minnesota

identification card on or after December 1, 2025, and before October 1, 2026. The amount

of a payment equals the amount charged for the duplicate credential, including a fee,

surcharge, and filing fee under Minnesota Statutes, section 171.06, subdivision 2, and a

filing fee under Minnesota Statutes, section 171.061, subdivision 4.

(b) The amount necessary is appropriated in fiscal year 2027 from the driver and vehicle

services operating account in the special revenue fund to the commissioner of public safety

for the payments under paragraph (a). This is a onetime appropriation.
