A bill for an act
relating to education; establishing student eligibility for postsecondary enrollment
options participation; amending Minnesota Statutes 2024, section 124D.09, by
adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2024, section 124D.09, is amended by adding a subdivision
to read:

Authorization; student eligibility.

(a) A postsecondary institution must
establish eligibility criteria for pupils applying to enroll in a course under subdivision 5.
The criteria must include:

(1) a minimum qualifying grade point average;

new text begin
(2) performance on a standardized assessment, such as an 8th grade Minnesota
Comprehensive Assessment or other standardized assessment used to assess student
preparedness for college-level courses; and

(3) class rank.

(b) A postsecondary institution may allow a pupil who does not meet the eligibility
criteria to enroll in a course under subdivision 5 if the pupil's enrolling district, charter
school, or American Indian-controlled Tribal contract or grant school submits a letter
recommending the pupil be permitted to enroll in a course for postsecondary credit.

(c) A pupil who enrolls in a course under this section and does not obtain a passing grade
is ineligible to enroll in a course under this section for the following quarter or semester.
