relating to public safety; establishing the crime of trespass in a sensitive space;

proposing coding for new law in Minnesota Statutes, chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Definitions.

(a) For purposes of this section, the following terms have

the meanings given.

(b) "Judicial officer" means a judge or justice of the United States, a United States

magistrate judge, or a clerk of the court authorized to sign a warrant pursuant to rule 9 of

the Federal Rules of Criminal Procedure.

(c) "Premises" has the meaning given in section 609.605, subdivision 1, paragraph (a),

clause (1).

(d) "Sensitive space" means:

(1) a public or nonpublic elementary, middle, or secondary school;

(2) a child care center licensed under Minnesota Rules, chapter 9503;

new text end

(3) a certified license-exempt child care center authorized under chapter 142C;

new text end

(4) a family day care or group family day care home licensed under Minnesota Rules,

chapter 9502, while children are present and receiving child care services;

(5) a church, synagogue, mosque, or other place of worship; or

new text end

(6) a hospital.

Prohibited conduct.

A person who enters the premises of a sensitive space for

the purpose of civil immigration enforcement without a warrant signed by a judicial officer

authorizing the arrest or detention of an individual and a reasonable belief that the individual

is on the premises is guilty of a misdemeanor.
