relating to education; modifying the construction project exception to the school
year calendar start date; amending Minnesota Statutes 2024, section 120A.40.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2024, section 120A.40, is amended to read:

(1) to accommodate a construction or remodeling project of

Construction or remodeling projects.

(a) A construction or remodeling project
that qualifies for an exception to begin the school year before Labor Day under subdivision
2, clause (1), must also meet the following requirements:

(1) the cost threshold of $500,000 or more must apply to a single school facility;
new text end
new text begin
(2) the construction or remodeling project must take place on the school site; and
new text end
new text begin
(3) the construction or remodeling project must not be completed while students are
present.

(b) A new construction project at a separate school site does not qualify for an exception
under subdivision 2.
