A bill for an act

relating to public safety; requiring policies for law enforcement relating to the

safety of elected officials in the community; proposing coding for new law in

Minnesota Statutes, chapter 626.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) By December 31, 2026, the Board of Peace

Officer Standards and Training shall develop a model policy to address the safety of elected

officials in the community. In developing the policy, the board must consult with the majority

and minority leaders of the senate and the speaker of the house and minority leader of the

house of representatives, the League of Minnesota Cities, the Association of Minnesota

Counties, the Judicial Council, the Minnesota Chiefs of Police Association, the Minnesota

Sheriffs Association, and the Minnesota Police and Peace Officers Association.

(b) The model policy, at a minimum, must require local law enforcement agencies to

maintain records regarding the addresses of elected officials in their jurisdiction, establish

a way to communicate with those elected officials, and provide security for those officials

as warranted.

agency shall develop, adopt, and implement a written policy regarding the safety of elected

officials in the community that is identical or, at a minimum, substantially similar to the

model policy adopted by the board under subdivision 1.

Licensing sanctions; injunctive relief.

The board may impose licensing

sanctions and seek injunctive relief under section 214.11 for failure to comply with the

requirements of this section.

As used in this section, "elected official" includes any person elected

to government office at the federal, state, or local level, including persons appointed to fill

vacancies in positions that normally require an election.
