A bill for an act relating to environment; authorizing counties to require watershed districts to use sources other than watershed district tax levy to complete projects; amending Minnesota Statutes 2024, section 103D.915, subdivision 2; proposing coding for new law in Minnesota Statutes, chapter 103D. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 2024, section 103D.915, subdivision 2, is amended to read: Subd. 2. Levy. new text begin Subject to the requirements of section 103D.917, new text end the auditor of each county in the watershed district shall add the amount of a levy made by the managers to the other tax levies on the property of the county within the watershed district for collection by the county treasurer with other taxes. The county treasurer shall make settlement of the taxes collected with the treasurer of the watershed district in the same manner as other taxes are distributed to the other political subdivisions. The levy authorized by this section is in addition to other county taxes authorized by law. Sec. 2. new text begin [103D.917] FUNDING ALTERNATIVES. new text end new text begin Subdivision 1. new text end new text begin County may require alternative funding. new text end new text begin Notwithstanding any other provision of this chapter, a county in a watershed district may prohibit the watershed district from levying taxes authorized under this chapter and may direct the watershed district to identify alternative sources of funding to complete projects. When a watershed district includes more than one county, prohibition by one county prohibits all other counties in the watershed district from levying taxes under section 103D.915, subdivision 2. new text end new text begin Subd. 2. new text end new text begin County review of project funding. new text end new text begin A watershed district must comply with a county request to review the proposed costs and sources of funding for a proposed watershed district project. A county may recommend modifications to the project, funding alternatives, and cost-saving measures to the watershed district. new text end
