A bill for an act relating to public safety; banning the sale or use of a specific chemical compound used in tear gas; amending Minnesota Statutes 2024, section 624.731, subdivision 1; proposing coding for new law in Minnesota Statutes, chapter 116. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. new text begin [116.382] ORTHOCHLOROBENZALMALONONITRILE; BAN. new text end new text begin (a) Notwithstanding section 624.731, subdivision 6, a person may not offer for sale, sell, purchase, use, or manufacture orthochlorobenzalmalononitrile or any product containing orthochlorobenzalmalononitrile in this state. new text end new text begin (b) The Minnesota Pollution Control Agency must provide guidance on proper disposal of existing supplies of orthochlorobenzalmalononitrile or of any products containing orthochlorobenzalmalononitrile possessed by persons in this state. new text end new text begin (c) For the purposes of this section, "orthochlorobenzalmalononitrile" means a chemical with the Chemical Abstract Services Registry Number 2698-41-1. new text end new text begin EFFECTIVE DATE. new text end new text begin This section is effective the day following final enactment. new text end Sec. 2. Minnesota Statutes 2024, section 624.731, subdivision 1, is amended to read: Subdivision 1. Definitions. For the purposes of this section: (1) "authorized tear gas compound" means a lachrymator or any substance composed of a mixture of a lachrymator including chloroacetophenone, alpha-chloroacetophenone deleted text begin ; deleted text end new text begin , new text end phenylchloromethylketone, deleted text begin orthochlorobenzalmalononitrile deleted text end or oleoresin capsicum, commonly known as tear gas; and (2) "electronic incapacitation device" means a portable device which is designed or intended by the manufacturer to be used, offensively or defensively, to temporarily immobilize or incapacitate persons by means of electric pulse or current, including devices operating by means of carbon dioxide propellant.
